<br />The Court further finds that the deceased,Thomas Herr,died seized,in fee,simple,of the following
<br />described real estate, to -wit:
<br />The South Half (SJ) of the Northeast quarter (NEJ),Section Eighteen (18),Township Nine (9) North,
<br />Range Eight (8),West of the 6th P.M.;
<br />The East Half (EJ),of the Northwest quarter (NWJ),Section Eighteen (18),Township Nine (9) North,
<br />Range Eight (9),West of the 6th P.M.;
<br />The Southwest quarter (SWJ),of Section Eighteen (18),Township Nine (9) North,Range Eight (9),West
<br />of the 6th P.M.and
<br />The Southwest quarter (SW4),of the Southwest Quarter (SW4),of Section Seven (7),Township Nine (9)
<br />North,Range Eight (S),West of the 6th p.M.
<br />all in Hamilton County, Nebraska; and
<br />The Northeast quarter (NE4),of the Northeast quarter (NEJ),of Section Thirty -three (33) Township
<br />Ten (10) North,Range Nine (9),West of_the 6th P.M.in Hall County,Nebraska.
<br />The Court further finds that all of the above - described real estate should now be assigned,as per
<br />the terms of said Will,in equal shares to the eight sons and daughters of deceased,as above
<br />named,that is,to each an undivided one- eighth (1/8) interest in and to all of said real estate.
<br />The Court further finds thatihe property belonging to said estate and the respective interests
<br />in and to the right or succession thereto are not in any manner liable for ot, subject to an
<br />Inheritance Tax or Estate Tax.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED BY THE COURT: That the Executors,Thomas Herr and
<br />Daniel Herr,now pay the balance in their hands,to -wit: $152.44,to the sons and daughters of said
<br />deceased,in equal shares,as hereinabove provided.
<br />IT IS HEREBY FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT:`lhat all of the real estate here -
<br />inaboveU described be and the same hereby is assigned,in equal shares,to the eight sons and
<br />daughters of said Thomas Herr,deceased,as per the finding hereiriab6ve• made.
<br />IT IS HEREBY FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT: That when the Executors shall have
<br />filed in this court vouchers showing the payment of the balance now in their hands to the persons
<br />entitled thereto,as per the finding hereinhbbve made,they shall stand discharged and their bond
<br />heretofore filed shall be released.
<br />IT IS HEREBY FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT: That all claims existing in favor
<br />of any person whomsoever against the deceased herein or this estate should be and they are hereby
<br />forever barred.
<br />A copy of the Last Will and 'testament of the deceased and a certificate of the probate thereof are
<br />hereto attached.

<br />After my death I want all my debts paid.
<br />50 dollars for Masses.
<br />10 sent to St.Joseph's Home,York St.,Jersey City.
<br />The rest of the money and bonds to be divided between my sons,Daniel,Thomas,Martin and my wife
<br />Elizabeth and my 5 daughters share equal to all shares alike.
<br />My wife Elizabeth to have all rents from lands and house until her death.Land and house to be sold
<br />after her death all to be sold by auctioneer.
<br />$500 dollars claim to be paid my son Thomas for improvement with his own money paid out of the
<br />money the old home brings. The rest of the money to be paid to my 3 sons and 5 daughters equal
<br />shares.
<br />Daniel and Thomas to be Administrators.
<br />Sell the car if I die and divide the money.
