<br />of DECREE OF FINAL SETTLEMENT AND
<br />DISTRIBUTION OF ESTATE
<br />THOMAS HERR,Deceased )
<br />Now on this
<br />17th day of June,1943,having been eontined.,from the 10th day of Apri1,1943,this cause comes on for
<br />hearing upon the petition of Thomas Herr and Daniel Herr,Executors,praying for the allowance of
<br />their final account filed herein,and for an order of distribution.
<br />The Court,from an investigation of the files in this case,finds that due notice had been given of
<br />the time and place of this hearing by publication,as provided by law and the order-of this Court;
<br />that the Court has acquired and now has jurisdiction over all the persons interested in and of the
<br />subject- matter of this action, and,no one appearing to object,tile opurt,after hearing the evidence
<br />and making an examination of the files and records herein,and being fully advised,finds that said
<br />final report is in all respects true and correct and should be and hereby is fully approved by the
<br />Court.
<br />That Thomas Herr departed this life on the 23rd day of September,1931,being at the time of his
<br />death a bona fide resident of Adams County,Nebraska,and leaving a Last Will and Testament,in which
<br />Thomas Herr and Daniel Herr were named as his Executors.That after due notice thereof,said Will
<br />was duly admitted to probate in this court on the 30th day of July,1942,and said Thomas Herr and
<br />Daniel Herr were on said date appointed Executors of the Last Will and Estate of said deceased,and
<br />they qualified for such office by taking the required oath and filing the bond fixed by the Court,
<br />and they then became,ever since have been and now are the duly appointed,qualified and acting
<br />Executors of the Last Will and Estate of Thomas Herr,deceased.
<br />That on July 30,19420said Executors filed in this court an inventory setting forth all of the prop-
<br />erty belonging to said estate,both real and personal,that had come into their possession or of
<br />which they had knowledge.
<br />That said deceased left surviving him as his next of kin and only surviving legal heirs,and who
<br />were also the beneficiaries named in his Will,the following 'r[a4ed persons,to -wit:
<br />ELIZABETH HERR,his widow,of Hastings,Nebraska,now deceased;
<br />MARGARET NEYLON,a daughter,of Hastings,Nebraska;
<br />FRANCES KROUTWICK (spelled Francis in the petition for probate of the Will), a daughter,of Hansen,
<br />Nebraska;
<br />ELIZABETH LEISURE,a daughter,of Clement Falls,Oregon;
<br />KATHARINE F.KOLB,a daughter;
<br />LENA BROOKS,a daughter,of Lincoln,Nebraska;
<br />DANIEL HERR,a son,of Doniphan,Nebraska;
<br />THOMAS HERR,apon,of Doniphan,Nebraska;and
<br />MARTIN HERR,a son,of Lincoln,Nebraska,
<br />all of whom are of legal age.
<br />That due notice was given to all persons interested to file their claims against said estate,as
<br />required by law,on or before November 6,1942,or said claims would be forever marred.
<br />No claims were filed against said estate,and the Court herein specifically finds that all claims
<br />not so filed and allowed should be forever barred.
<br />The Court further finds that the costs of the las llness,the funeral expenses,and the costs of the
<br />administration of this estate have been fully pai .
<br />The Court further finds that after the payment of all of the items above mentioned,there is still
<br />in the hands of the Executors for distribution a balance of $152.44,and that said amount should
<br />be distributed,as per the terms of said Will,in equal shares to the above named sons and daughters
<br />of deceased,that is to say:
