Register of Deeds o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o- o -o -oo DECREE 1 THE COTT''TY COURT OF BALL COUT?TY,I ?EBRASF:A. ,11 In the 1f:atter of the Estate ) of ) DECREE LIZZIE I:.iIOELLER,Deceased. ) ITOW on this 10th day of June,19113, this cause came on for hearing upon the petition of Hans Modller of Grand Island,Pdebraska,praying for a settlement of the estate of said deceased,for a determin- ation of her heirship and the right of descent of her real estate,and the degree of kinship of her heirs -at -law and for a decree settling her estate.And it appearing to the court from the proof on file and from the evidence submitted,that due and legal notice has been given by publi- cation for three successive weeks,as by law and the order of this court provided,to all creditors, heirs -at -law and ot''er persons interested in said estate,of the filing of said petition and of the time and place fixed for the hearing tlereon,and there being no objections thereto,this cause was duly submitted to ;.tree court, and the-7court being fully advised in the premises finds that the allegations of. said petition are true,that the said petitioner,Hans Mloeller,is the owner of the real estate hereinafter described and is a competent and proper person to-prosecute this proceeding. The court further finds that the said Lizzie 1M.Moeller departed this life intestate at Grand Island,llelhra.ska,on the 21st day of November,1908,that at the time of her d, ath,she was a resident and inhabitant of Hall County, Nebraska.; that at the time of her death she was tie owner of Lots Three and Four (3 & 4) in Fractional Block Fourteen (14) in Evans' Addition to the City of Grand Island;that more than two years have elapsed since her death and that no application has ever been made in the State of ITebraGho. for the appointment of an administrator of .1ner estate, and no petition filed for that purpose,and that no administration has ever been had on the estate of the said Lizzie L.Tv1oeller. The court further finds that the said Lizzie TI.Pv?oeller left surviving her as her heirs -at -law and only heirs at lacy the following narked persons,to- wit: Hans 1oeller,surviving husband, petitioner herein,of Grand Island,17ebraska,and Irene 11oeller, an adopted daughter,residing in Grand Island, Nebraska; that under the laws of the State of TTebraeka in force at the time of the death of the said Lizzie 1.1.1,'oel1.er, the said real estate hereinabove described passed and descended by absolute titld to the said Hans IMoeller and Irene Moeller, shame and share alike, subject to the homestead rights of the said Hans I ;oeller in and to said prer,:ises. The court further finds that the funeral expenses of the deceased and all other debts against said estate have been fully paid and that if any other claims existed,the same are forever barred and precluded and the court further finds than the costs of this proceedings has been paid. IT IS THEREFORE ORDERED,ADJUDGED,AND DECREED BY THE COURT that the said Lizzie M.Moeller died intestate in Hall County,hTebraska,on Yovember 21,1909;that no application for the a-cpointment of an administrator of her estate has been made nor has there ever been any adminstfttl:on on her estate in the State of Nebraska;that she died seized as the owner of the real estate herein above described in Hall County, that the said Hans !Ioeller,petitioner herein, is a competent and qualified person to prosecute this proceeding,that said deceased left surviving her,as her heirs at law and only heirs- at- law,Hans Tdoeller,her husband and Irene 1:Ioeller,an adopted daughter,that upon the death of the said Lizzie I�I.I�Loeller the real estate herein described passed and descended in absolute title under the intdstate laws of the State of l -lebrasha in force at the time of the death of the said Lizzie Y .1:'oeller, to Hans IuIoeller and Irene Moeller, share and share alike subject to the homestead rights of the said Hans -oeller in and to said premises. IT IS FURTHER ORDERED,ADJUDGED,AND DECREED BY THE COURT that all debts of said deceased and of her estate,if any such there were,are forever barred and precluded,and that further administration of said estate is dispensed with and said estate is finally settled and forever closed.
