<br />THE LAST WILL OF KARL TUENGE
<br />I,Karl Tuenge of Grand Island,Nebraska,make this my last will,hereby revoking all former wills
<br />by me made.
<br />I hereby appoint my son -in -law Hermann Kruse executor of this will and direct that he be not
<br />required to give any surety on his bond.
<br />To my dearly beloved wife I hereby give house and lot at 705 West 6th Street in Grand Island,
<br />Hall County,Nebraska,the same being my home to her and to her heirs and assigns forever,subject.
<br />to a charge of Eleven Hundred Dollars in favor of my son -in -law Herman Kruse.To my said son-in-
<br />law Hermann Kruse I give the sum of eleven Hundred dollars,to him and to his heirs and assigns
<br />forever to be paid out of my home as above provided. The rest,residue and remainder of my proper-
<br />ty I give devise and bequeath to my wife and my daughters Bertha Kruse and Martha Reinke in pro-
<br />portion as the laws of Nebraska provide in event of intestacy.
<br />Done this 24th day of January,1939.

<br />We whose names are hereunto subscribed do hereby certify that Karl Tuenge,the testator,subscribed
<br />his name to the foregoing Will in our presence and we in his presence and at his special request
<br />and in the presence of one another have subscribed our names as witnesses hereto after he declared
<br />the foregoing to be his last will and testament at the date thereof.

<br />Carl Tuenge,Deceased I,Paul N.Kirk,Judge of the County Court in and for said County,
<br />do hereby certify that on the 27th day of November,1942,the
<br />instrument purporting to be the last will and testament of Carl Tuenge,deceased,was filed for
<br />probate in this Court.That on the 23rd day of December,1942,said instrument to which this certif-
<br />icate is attached was duly proved,probated and allowed as the last will and testament of the real
<br />and personal estate of said Carl Tuenge,deceased,and the same was ordered to be recorded in the
<br />records of the Court aforesaid.
<br />In witness whereof I have hereunto set my hand and affixed the seal of the County Court,this 23rd
<br />day of December,1942.

<br />FOURTH
<br />The Court further finds that said Fritz W.Meinke was appointed Administrator With WiT1 Annexed on
<br />his giving bond in the sum of $500.00, which bond was duly furnished,filed and approved and
<br />Letters of Administration with said Will annexed, were issued to said Fritz W.Meinke, and he was
<br />given oneyear in which to settle said estate.
<br />FIFTH
<br />The Court further finds that on the 23rd day of December,1942,an order of this Court was made
<br />allowing creditors three months from January 20,1943,in which tp present claims against said
<br />estate for examination and allowance at the office of the County Judge of Hall County,Nebraska,
<br />and fixing a time for hearing on claims filed against said estate on the 23rd day of April,1943,
<br />at 9 o'clock A.M. in the office of the County Judge of Hall County,Nebraska,and further ordering
<br />that notice of the same be given to all persons interested and to the creditors of said estate,
<br />by publishing such notice for three successive weeks prior to-January 20,1943,in the Grand Island
<br />Independent,a legal newspaper published and circulating in Hall County,Nebraska,and it appears by
<br />proof on file,that notice of said order was published as ordered by this Court.
<br />SIXTH
<br />The Court further finds that on the 24th day of December,1942;said Fritz W.M einke,as Administrator
<br />With Will Annexed,filed in this Court his inventory of the property of said estate,and that accord -
<br />ing to said inventory,the said Carl Tuenge,also known as Karl Tuenge and also known as Carl Tinge,
<br />being one and the same person irrespective of such discrepancy in the spelling of said names,
<br />died seized and possessed of the following described property,to -wit:
<br />Lot One (1) in Block Eight (8) of Rollins' Addition to the City of Grand Island,Nebraska.
<br />and chattel property of the value of $15.00 and household furniture of the value of $100.00
<br />SEVENTH
<br />The Court further finds that the following are the heirs- at-law and only heirs -at -law of said
<br />Carl Tuenge,deceased: Emelie Tuenge,his widow,Bertha Kruse,a daughter and Martha Meinke,a daughter,
<br />all over the age of 21 years,and pursuant to,under and by virtue of the terms and provisions of
<br />said Last Will and Testament,said real estate did pass and descend and was devised unto said
<br />Emelie Tuenge in fee simple absolute,subject,however,to a charge of $1100.00 in favor of Herman
<br />Kruse,rho departed this life on November 18,1942;that said chattel property is all exempt unto
<br />said Eihelie Tuenge as widow of said Carl Tuenge,deceased,and is therefore hereby set over to her
<br />and to her heirs forever.
<br />EIGHTH
<br />The Court further finds that all claims and debts against said estate and the costs of administ- - ',
