268 <br />co-) ut <br />THEAUGUSTMECO. 20112.2.41 <br />My farm, described as the South Half of the Southeast Quarter (SSE) of Section Fifteen (15) <br />and the Northwest Quarter (Vi) of Section Twenty -Six (26), all in Township Twelve (12), North, <br />Range Ten (10), West of the 6th P.M. in Hall County, Nebraska., I devise unto my son Fred Wiese, <br />to him and to his heirs forever upon the following terms and conditions: <br />After this Will has been duly admitted to probate, I provide that the County Judge of Hall County, <br />Nebraska, appoint two competent and qualified appraiders who in turn shall select a third appraiser, <br />and all three shall be paid for their services as said County Judge may determine fair and reason- <br />able; said appraisers shall within thirty days from the date of their appointment, appraise said <br />real estate and make a written report thereof with the valuation thereof to the County Judge <br />signed by_all three of them; in the event all three cannot agree upon the fair and reasonable <br />market value of said real estate at that time, then the valuation agreed upon by two of them <br />shall be controlling herein; upon the filing of such aporaisal, I hereby rovide that my said <br />son Fred Wiese shall pay unto my daughter Maria Brabander one- fourth (1 74j of such appraised <br />valuation) and to my daughter Martha Reher one - fourth (1/4) of such appraised valuation, and I <br />hereby devise and bequeath such amount to each of them and to their heirs forever; in the <br />event my son Fred has not made payment to them thereof within one year after my death, then said <br />real estate shall be sold by my said Executors, I hereby giving them authority and power so to do, <br />and the proceeds thereof divided, after payment of all expenses incident thereto, one-�half (112) <br />to my son Fred Wiese, one - fourth (1/4) to my daughter Maria Brabander, and one- fourth(1 /4) to my <br />daughter Martha Reher; I specifically provide that my son Fred Wiese shall be required to pay no <br />interest to my said daughters during the period allowed.. him herein to make such payment to them <br />out of such appraised valuation. <br />6. <br />I have loaned money and made advancements to my children from time to time for which I hold <br />their promissory notes, and I hereby provide that all such notes held by me at the time of my <br />death with accrued interest as therein provided, whether the Statute of Limitations has run <br />against said notes or any of them, or not, shall be paid to my Executors by such debtor children <br />by the time said Executors are ready to close my estate; in the event they or any of diem have <br />failed to so pa.y such indebtedness, such indebtednesses shall::and_are hereby made a charge and a <br />lien upon the share of such debtor in my estate, both against their, his or her share of my personal <br />property as well as of my real estate; and my Executors shall deduct such sum from the share of <br />such debtor son or daughter before making settlement with him or her or them. <br />Done at Grand Island.,Nebraska, this 25th day of August, 1942. <br />Bernhard Wiese <br />Testator <br />We, whose names are hereunto subscribed, do hereby certify that Bernhard Wiese, the testator, <br />subscribed his name to the foregoing instrument consisting of three pages in our presence and in <br />the uresence of each of us, and at the same time and in our presence and hearing, declared the same <br />to be his Last Will and Testament, and we, at his special instance and request and in his presence <br />gnd. in the presence of each other, have hereunto subscribed our names as attesting witnesses. <br />Lela A.Gjilsteen <br />Herbert F. That on the 29th day of October, 1942, said <br />instrument to which this certificate is attached was duly proved, probated and allowed as the last <br />will and testament of the real and personal estate of said Bernhard Wiese, deceased, and the same <br />was ordered to be recorded in the records of the Court aforesaid. <br />In Witness Whereof, I have hereunto set my hand and affixed the seal of the County Court, this <br />29th day of October, 1942. <br />(SEAL) <br />Paul N.Kirk <br />County Judge <br />FOURTH. <br />The Court further finds that on said 28th day of October, 1942, pursuant to the provisions set <br />forth in paragraph Fifth of said Last Will and Testament, this Court entered an order appointing <br />Herman Schipman and William Fagan appraisers of the South Half of the Southeast Quarter of Section <br />Fifteen and the Northwest Quarter of Section Twenty-Six, all in Township Twelve North,Range Ten, <br />West of the 6th P.M. in Hall County, Nebraska., and directed them to select a third appraiser to <br />appraiser the fair and reasonable market value of said real estate as of September 25, 1942, and <br />file their report thereof -in writing with this Court within thirty days thereafter; that on the <br />21st day of November, 1942, said William Fagan, Herman Schipman and R. S.Wenger, being the third <br />appraiser, seleoted by said other two appraisers, filed their report in writing with this Court, <br />appraising the above - described real estate at $12,000.00 as of September 25, 1942, and on said <br />21st day of November, 1942, this Court entered an order ap -,)roving the report of said appraisers <br />and fixing their fees in the sum of $5.00 each, together with their mileage, which fees and <br />expenses have been fully paid by said Executors. <br />FIFTH. <br />The Court further finds that on the 21st day of November, 1942, said Fred Wiese and William <br />Reher, Executors herein, filed in this Court their inventory of the property of said estate and <br />that according to said inventory the deceased died seized and possessed of the following described <br />property, to -wit: <br />Block Eight (9) in Pleasant Home Subdivision, being a part of the East Half of the <br />Southeast Quarter (E2SE$) of Section Twenty -one (21) in Township Eleven (11),North, <br />Range Nine (9), West of the 6th P.M. in Grand Island, Hall County, Nebraska. <br />The South Half of the Southeast Quarter (SiSE1) of Section Fifteen (15) and the <br />Northwest Quarter (NA) of Section Twenty -six (26), all in Township Twelve (12) <br />North,Ra.nge Ten (10), West of the 6th P.M. in Hall County, Nebraska. <br />L <br />1 <br />C <br />1 <br />G <br />
