267 <br />LAST WILL AND TESTAMENT OF BERNHARD WIESE <br />I, Bernhard Wiese, of Grand Island, Nebraska, being of sound mind and disposing memory, do <br />hereby make, publish, and declare this my Last Will and Testament, hereby revoking all former <br />Wills and Codicils by me made, in words as follows: <br />1. <br />I appoint my son Fred Wiese and my son -in -law William Reher joint executors of this Will and <br />provide that neither shall be required to give surety on their respective bonds. <br />2. <br />I direct my said executors to pay the expenses of my last illness and burial, the expense-of <br />administering my. estate -and probating this Will, and all my just debts out of my personal property <br />and in the event that should be insufficient, then so much of my real estate shall be sold as is <br />necessary to pay the same without first obtaining leave of any Court or Judge for that purpose; <br />I further direct my said executors to arrange for and pay for a curbing around my grave similar <br />to those now on -my cemetery lot, and also to have engraved and pay for-same the tombstone now on <br />said lot, inscribinIg thereon the usual inscription with reference to myself. <br />3• <br />I hereby bequeath all of the rest, residue and remainder of my personal estate as follows: <br />To my grandson Bernhard Brabander the sum of 1125.00 <br />To my grandson Walter Brabander the sum of $125.00 <br />To my grandson Arthur Brabander the sum of 0125.00 <br />To my grandson Orville Brabander the sum of $125.00 <br />To my granddaughter Genevieve Brabander the sum of $125.00 <br />but if she is a minor at the time of such payment, then my Executors are hereby authorized <br />to pay her lagacy to her mother, Maria Brabander, for Genevieve, and to accept the receipt <br />of her mother therefor. <br />To my grandson Hugo Wiese the sum of $125.00 <br />To my grandson Arnold Wiese the sum of $125.00 and to my <br />grandson Glen Wiese the sum of $125.00, but if they or either of them are minors at the <br />time of such payment, then my Executors are hereby authorized to pay such legacies of such <br />minor to their or his father, Fred Wiese, and to accept the receipt of such father therefor. <br />To my granddaughter Viola Reher Grotz the sum of $125.00 <br />To my grandsons Donald Reher, and William Reher and my granddaughter Bernice Reher the <br />sum of 4125.00 each, but if they or any of them are minors at the time of such payment, <br />then my Executors are hereby authorized to pay such legacies of such minor to their, his <br />or her mother, Martha Reher, and to accept the receipt of their mother therefor. <br />The balance of my personal estate, I give and bequeath unto my three children, Fred Wiese, <br />Maria Brabander and.Martha Reher, share and share alike, to them and to their heirs forever. <br />4. <br />I hereby devise Block Eight (9) in Pleasant Home Subdivision, being a part of the East Half <br />of the Southeast Quarter (ESE) of Section Twenty -one (21), in Township Eleven (11) North,Range <br />Nine (9),West of the 6th P.M. in Grand Isla.nd,Hall County, Nebraska, unto my said three children, <br />Fred Wiese, Maria Brabander and Martha Reher, share and share alike, to them and to their heirs <br />forever. <br />WILL AND DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />IN THE MATTER OF ) <br />THE ESTATE OF ) FINAL DECREE. <br />BERNHARD WIESE, deceased. ) <br />At a session of the Coiinty Court held in and for said County of Hall this 19th day of May, <br />1943, Present: Paul N.Kirk, County Judge. <br />BE IT REMEMBERED that on the 21st day of April, 1943, Fred Wiese and William JRehpr,. , <br />Executors Estate Bernhard Wiese, <br />of the of deceased, filed in this Court their final account as <br />such Executors, and a petition praying that said account be allowed, for a decree of heirship, <br />order of distribution, final settlement thereon and discharge. <br />For these purposes, the 19th day of May, 1943,at 10 o'clock A.M. at the County Court Room in <br />said County was assigned as the time and place for hearing said petition, examining and allowing <br />said. account; and it was ordered that notice of the pendency of said petition and the hearing <br />thereof be given to all persons interested in said matter by publishing such notice in the Grand <br />Island Independent, a legal newspaper printed and published in said County for three successive <br />weeks prior to said day of hearing, and it appears by proof on file that said notice was given <br />as ordered by Court and no objections have been made or filed thereto and that the same should <br />be allowed. <br />Upon an examination of the record and the evidencein this matter, and being duly advised in <br />the premises, the Court finds as follows: <br />FIRST. <br />That Bernhard Wiese departed this life on the 25th day of September, 1942, in Hall County, <br />Nebraska, testate, and at the time of his death he was a resident of said Hall County, Nebraska. <br />SECOND. <br />That on the 3rd day of October, 1942, Fred Wiese, Maria Brabander and Martha Reher, filed in <br />this Court a petition setting forth the above facts and offering the Last Will and Testament of <br />Bernhard Wiese, deceased, for probate, which instrument purporting to be the Last Will and Testa- <br />ment of said Bernhard Wiese, deceased, was filed by them in this Court on October 3, 1942, wherein <br />Fred Ifiese and William Reher are named Executors;
