<br />the time of his death he was a resident of said Hall County, Nebraska.
<br />SECOND.
<br />That on the 24th day of April, 1936, Lola M.Walker, his sister, filed in this Court a petition
<br />setting forth the above facts and praying for administration of his estate; that said Ralph M.
<br />Bootman departed this life intestate and that Ernest L.Walker be appointed Administrator of his
<br />estate; and on the 24th day of April, 1936, this Court entered an order assigning the 19th day of
<br />May, 193', at 10 o'clock A.M. at the County Court Room in said County as the time and place for
<br />hearing said petition and ordering that notice of the hearing on said petition be given to all
<br />persons interested in said matter by publishing notice thereof in the Grand Island Independent,
<br />a le;; --al newspaper printed in said County, for three successive weeks prior to said day of hearing,
<br />and it appears by proof on file that notice of said order was given as ordered by this Court.
<br />THIRD.
<br />The Court further finds that at said time and place and hearing, said ?.)etition was granted
<br />and said Ernest L.Walker was appointed Administrator of this estate upon his giving bond in the
<br />sum of $1,000.00 which bond he filed and which was ap?)roved on the 19th day of May, 1936, and he
<br />took his oath of office and qualified as such and Letters of Administration were issued to said
<br />Ernest L.Walker on May 19, 1936, and he was given one year in which to settle said estate.
<br />FOURTH.
<br />The Court further finds that on the 19th day of May, 1936, an order of this Court was made
<br />allowing creditors three months from and after the 19th day of June, 1936, in which to present
<br />claims against said estate for adjustment and allowance at the office of the County Judge of Hall
<br />County, Nebraska, and fixing a time for hearing on claims filed against said estate, on the 9th day
<br />of September,1936, at 9 o'clock A.M. before me at the County Court Room in said County and further
<br />ordering that notice of the same be given to all persons interested, and to the creditors of said
<br />estate by jublishing such notice for three successive weeks prior to the 9th day of June, 1936, in
<br />the Grand Bland Independent, a legal newspaper published and circulating in Hall County, Nebraska,
<br />and it appears by proof on file that notice of said order was published as ordered by this Court.
<br />The Court further finds that no claims were filed against this estate within the time so fixed
<br />by this Court and that any and all claims not so filed, are hereby barred and enjoined from being
<br />presented against said estate or the assets thereof.
<br />FIFTH
<br />The Court further finds that on the 9th day of September, 1936, said Ernest L.Walker,as
<br />Administrator, filed in this Court his inventory of the property of said estate and that according
<br />to said inventory, the deceased died seized and possessed of the following described property to-
<br />wit: An undivided 3%8 interest in and to Lot Ten (10) in Block Thirty -two (32) in Russel Wheeler's
<br />Addition to Grand Island, in Hall County, Nebraska, subject to the life estate in said premises for
<br />the term of the life of Joseph Smith, which life estate was held by Lola Walker; also $880.00 in
<br />cash.
<br />SIXTH.
<br />The Court further finds that the following were the heirs -at -law and only heirs -at -law of said
<br />Ralph M.Bootman, deceased; Cyril Bootman and Lester Bootman, his sons, if living, and if not living,
<br />then Lola M.Walker, his sister, all over the age of 21 years, and that under the law of descent and
<br />distribution of this State, the property of this estate, as described in paragraph Fifth hereof,
<br />passed and descended by operation of law unto said Cyril Bootman and Lester Bootman, sons of said
<br />Ralph M.Bootman, if living, share and share alike, and if not living, then unto Lola M.Walker,.
<br />his sister, in fee simple absolute.
<br />SEVENTH.
<br />The Court further finds that all debts and claims against said estate and the costs of admin-
<br />istration in said estate, including court costs, administrator's Pees and attonney's fees, have
<br />been fully paid and that there remains in the hands of said Administrator, the sum of $127.46 in
<br />cash.
<br />EIGHTH
<br />The Court further finds that after deducting from the assets of said estate, the debts, costs of
<br />administration, and other proper expenditures and the stahtory exemptions allowed said heirs -at -law,
<br />that there is due and payable to the County Treasurer of Hall County, Nebraska, no'inheritance tax
<br />whatsoever, and no estate tax is due the United States of America..
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Ernest L.
<br />Walker as Administrator of said estate be and the same is hereby approved and allowed as such,
<br />and that said Ralph M.Bootman left him surviving as his heirs -at -law and only heirs -at -law, the
<br />persons named in paragraph Sixth of this decree, and that the property described in paragraph
<br />Fifth of this decree passed and descended under the laws of this State, unto said heirs as here -
<br />inbefore found; that settlement of said. estate has been completed and of the remaining 4127.46
<br />left in the hands of said Administrator, upon his paying said money over to the persons entitled
<br />thereto as hereinbefore foi.and and filing receipts showing such payment, that he be granted a
<br />discharge herein and his bond released.
