<br />In the Matter of The Estate of Mary Ellen Herr } DECREE OF

<br />NOW, on this 27th day of Jan,_iary, 1943, this matter came on for hearing before the Court on the
<br />petition of Dan Herr, and the Court finds that due and legal notice of the time, place, and purpose
<br />of this hearing has been given to all persons interested in said estate, both creditors and heirs -
<br />at -law in the manner provided by law.
<br />THE COURT FINDS that Mary Ellen Herr departed this life intestate on the 11th slay of June,1940,
<br />being at that time a resident of Hall County, Nebraska; that at the time of her death, she was
<br />seised of:
<br />1. An undivided seven - sixteenths (7/16} interest in and to the following described
<br />property: Part of the NW4 of the SE4 of section 5, Township 9, North,Range 9, West
<br />of the 6th P.M., described as follows: Beginning at a point in the East Line of the
<br />right of way of the St. Joseph and Grand Island Railroad 542.75 feet South of the
<br />North Line of said SE-41 of Section 5, running thence -East Parallel with the said North
<br />Line, 610 feet; thence South 142.75 feet, thence West, parallel with said North Line
<br />610 feet to said East Line of right of way, and thence North 142.75 feet to the place
<br />of beginning, containing 2 acres, be the same a little more or less, all in Hall County,
<br />Nebraska, also,
<br />2. An undivided one -half ( *) interest in and to the following described property:
<br />Two acres of land, commencing at the northwest corner of the SE4 of Section 5, Range
<br />9 Twp. 9 in Hall County, Nebraska, thence 57 feet east to center of track of the St.
<br />Joseph and Grand Island Railroad, thence 700 feet South to the center of said track
<br />thence 50 feet East to the place of beginning, thence East 610 feet, Thence South 142
<br />feet and 9 inches, thence West 610 feet, thence North 142 feet and 9 inches to the point
<br />of beginning, all in Hall County, Nebraska.
<br />That she left surviving her as her only heirs at law, Dan Herr, husband and this petitioner;
<br />and Henry Edward Clarno, borther; that the petitioner, being the husband of the deceased is
<br />owner of an interest in the above property.
<br />THE COURT FINDS that no sufficient administration has been had upon the estate of said deceased
<br />in the State of Nebraska, no applications or proceedings for administration as provided by law
<br />have geen commenced or are now pending in this state.
<br />THE COURT FURTHER FINDS THAT the said Mary Ellen Herr left surviving as her sole and only
<br />heirs at law and the only persons entitled to participate in her estate, her husband, Dan Herr
<br />and a brother, Henry Edward Clarno.
<br />THE COURT FURTHER FINDS THAT the funeral expenses of said deceased have been paid, and that
<br />there are now existing no debts against the estate of said deceased, that more than two years
<br />have elapsed since the death of the deceased, and no claims are now provable. That there is no
<br />personal property to be administered, and that neither said estate nor the heirs, at law are subject
<br />to estate or inheritance taxes, and that there is no necessity for administration.
<br />IT IS, THEREFORE, CONSIDERED, ADJUDGED AND DECREED By the Court that the said Mary Ellen #err
<br />died as above set forth; that she left her surviving as her sole and only heirs at law and the
<br />only persona entitled to participate in her estate, the persons whose names and kinship are as
<br />above found. That the lands and premises above described, passed and descended to the brother,
<br />and husband of the deceased in accordance with the intestate laws of the State of Nebraska in
<br />force at that time; namely, to each Dan Herr and Henry Edward Clarno an undivided 7/32 interest
<br />in and to the following described property:
<br />Part of the NW4 of the SE4 of Section 5, Township 9, North,Range 9, west of the 6th P.M.,
<br />described as follows: Beginning at oint in the East Line of the right of way of the
<br />St. Joseph and Grand Island Railroad 842.75 feet South of the North Line of said SE4 of
<br />Section 5, running thence East, parallel with the said North Line, 610 feet; and thence
<br />South 142.75 feet; thence West, parallel with said North Line 610 feet to the said East
<br />Line of right of way, and thence .North 142.75 feet to the place of beginning, containing
<br />2 acres, be the same a little more or less, all in Hall County, Nebraska.
<br />and to each Dan Herr and Henry Edward Clarno, an undivided 1/4 interest each in and to the
<br />following described property:
<br />Two acres of land, commencing at the Northwest corner of the SE4 of Section 5, Range 9, Township
<br />9, in Hall County, Nebraska, thence 57 feet East to center of track of the St. Joseph
