<br />CODICIL TO LAST WILL AND TESTAMENT

<br />MARGARET SAVAGE.
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />That I, Margaret Savage, of Grand Island,Hall County, Nebraska, being of sound mind, and disposing
<br />memory, but not unmindful of the uncertainties of human life, do hereby make, publish and declare
<br />this to be a codicil to my last Will and Testament, dated September 9, 1925;

<br />I hereby substitute for the Sixth paragraph of said last Will and Testament, the following:
<br />"I hereby request the Court to appoint my daughter, Grace Denman, and my son -in -law,
<br />Howard Kirkman, to be the Executors of this, my last Will and Testament, and request
<br />that no bond be required of them except their own personal recognizance."

<br />The remainder of my said last Will and Testament is to remain in full force and effect, and I
<br />do hereby republish and re- declare the same to be my last Will and Testament as amended in this
<br />Codicil.
<br />Dated this 22nd day of June, 1940.

<br />We, whose names are hereunto subscribed, do hereby certify that Margaret Savage, the testatrix,
<br />she then being bf sound mind and under no compulsion, executed the foregoing instrument in our
<br />presence and in the presence of each of us, at the same time declaring that said instrument was
<br />a Codicil to her last Will and Testament, and we, at her request, and in her presence, and in the
<br />presence of each other, subscribe our names hereto as attesting witnesses.

<br />on the 19th day of November, A.D. , 1942.

<br />I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on
<br />the 22nd day of October, 1942, the instruments purporting to be the last will and testament and
<br />Codicil thereto of Margaret Savage deceased, were filed for probate in this Court. That on the
<br />18th day of November, 1942, said instruments to which this certificate is attached were duly
<br />proved, probated and allowed as the last will and testament and Codicil thereto of the real and
<br />personal estate of said Margaret Savage deceased, and the same was ordered to be recorded in the
<br />records of the Court aforesaid.

<br />MARGARET SAVAGE, Deceased.
<br />Now on this 5th day of May, 1943, this cause came on to be heard on the Final Report of Grace
<br />Denman and Howard Kirkman, Executors under the last Will and Testament of Margaret Savage, deceased;
<br />and it appearing to the Court that notice of the filing of said Final Report has been given in the
<br />manner and form provided by law; there being no objections thereto and there having been filed in
<br />this court a consent in writing signed by each of the three surviving daughters of the said Margaret
<br />Savage, to -wit: Ivy Simpson, Grace Denman and Prudence Wynne;
<br />IT Is THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of the Execu-
<br />tors be and the same is hereby approved.
<br />,The Court further finds that Ivy Simpson, Ivy May Simpson and Mrs. Ivy Simpson, wherever the
<br />same are used in these proceedings or to the title to the real estate involved in this action, are
<br />one and the same person, the daughter named in the third paragraphs of the last will and testament
<br />as Mrs. Ivy Simpson.
<br />The Court further finds that the daughter named in the third paragraph of the last Will and
<br />Testament as Mrs. Hazel Kirkman predeceased her mother, Margaret Savage, and that the said Mrs.
<br />Hazel Kirkman, being one and the same person as Hazel F.Kirkman, died on'May 10, 1940, and that
<br />she left her surviving no child or children.

<br />The Court further finds that wherever in these proceedings the name J.G.Savage�is used, gat
<br />it refers to one and the same person, the husband of the said Margaret Savage.
<br />The Court further finds that Margaret Savage, Margaret A.Savage, Margaret Shilts and Margaret
<br />A.Shilts, wherever used in these proceedings or with resepct to the title to Lot One (1) in Block
<br />One Hundred Twenty -Two (122) of Union Pacific Railway Company's Second Addition to the City of
<br />Grand 'Lsland,Nebraska, refer to one and the same person, to -wit; the testator in these proceedings.
