<br />said account; and it was ordered that notice of the pendency of said petition and the hearing
<br />thereof be given to all persons interested in said matter by publishing such notice in the Grand
<br />Ieland.Independent, a legal newspaper printed in said County, for three weeks prior to said day
<br />of hearing, and it appears by proof on file that said notice waa given as ordered by Court and no
<br />objections have been made or filed thereto, and that the same should be allowed.
<br />Upon an examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST
<br />That Carl Dill, also sometimes known as Charles Dill, departed this life on the 6th day of
<br />July, 1942s in Hall County, Nebraska, testate, and at the time of his death, he was a resident
<br />of Hall County,-Nebraska.
<br />SECOND.
<br />That on the 18th day of July, 1942, Albert J.C.Moeller filed an instrument purporting to be the
<br />Last Will and Testament of said Carl Dill, deceased, in this Court and a petition offering said will
<br />for probate, wherein said Albert J.C.Moeller was named Executor; and on the 20th day of July,1942,
<br />an order of this Court was made therein, assigning the 12th day of August, 1942, at 10 o'clock A.M.
<br />at the County Court Room in said County, as the time and place for hearing said petition and proving
<br />said Will and ordering that notice`of the pendency of said petition and the hearing-thereof be given
<br />to all persons interested in said matter by publishing a copy of said order in the Grand Island
<br />Independent, a legal newspaper printed in said County, for three successive weeks prior to said
<br />day of hearing, and it appears by proof on file that notice of said order was given as ordered by
<br />this Court.
<br />THIRD.
<br />The Court further finds that at said time and place, said Will was duly proven and allowed and
<br />admitted to probate, which Will is in words as follows:
<br />LAST WILL AND TESTAMENT OF CARL DILL OF GRAND ISLAND,NEBRASKA
<br />IN THE NAME OF GOD,
<br />THE FATHER,SON AND HOLY GHOST.
<br />AMEN.
<br />I, Carl Dill, being of sound mind and memory, -and in considering the uncertainties of this
<br />mortal "Life, do hereby make, publish and declare this my last will and testament, in words and
<br />figures following, to -wit:
<br />1.
<br />I direct that all my just debts, including the expenses of my last sickness, death and burial
<br />be paid out of my personal estate.
<br />2.
<br />I give, devise and bequeath to the Evangelical Lutheran Synod of Missouri, Ohio, and Other
<br />States (a Missouri corporation) the sum of One Thousand Five Hundred Dollars ($1,500.00); the sum
<br />of Five Hundred Dollars ($500.00) to be disbursed for the benefit of their Negro Mission; Five
<br />Hundred ($500.00) for their Mission in Africa; and Five Hundred Dollars ($500.00) for the Orphanage
<br />of the Evangelical Lutheran Free Church of Saxony and Other States in Germany, or for some other
<br />purpose or purposes determined by said Synod, and the receipt of the Treasurer of said corporation
<br />shall be sufficient to discharge my executor of same.
<br />3.
<br />I give, devise qnd bequeath to the Lutheran Orphan Home of P"remont, Nebraska, Five Hundred
<br />Dollae- 4500.00), and the receipt of the Superintendent shall be sufficient discharge to my-executor
<br />of the same.
<br />4.
<br />All the rest, residue and remainder of my estate of every kind and nature, both real and personal
<br />or mixed, and wheresoever situated, I give, devise and bequeath to Trinity Evangelical Lutheran
<br />Church of Grand Island, Nebraska, to have and to hold to the said congregation, and to its assigns
<br />forever.
<br />I hereby nominate Albert J.C.Moeller, my Pastor, as Executor of this my Last Will and Testament,
<br />and request that he be permitted to qualify without bond. He is to receive the sum of One Hundred
<br />Dollars 0100.00) as honorarium.
<br />I hereby revoke any and all former wills by me made.

<br />I. Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on the
<br />18th day of July, 1942, the instrument purporting to be the last will and testament of Carl Dill,
<br />deceased, was filed for probate in this Court. That on the 12th day of August, 1942, said Instru-
<br />ment to which this certificate is attached was duly proved, probated and allowed as the last will
<br />and testament of the real and personal estate of said Carl Dill, deceased, and the same was ordered
<br />to be recorded in the records of the Court aforesaid.
