252 WILL AND DECREE RECORD THERUGUSTINE CO. 20112.2.41 That authenticated copies of said determination of heirship of the Deceased, in said Superior Court of the County of Los Angeles and State of California., are attached to the petition herein, marked exhibit "A" and made a part thereof. The Court further finds that the Grand Island Trust Company of Grand Island,Nebraska was appointed trustee for the benefit of the Deceased, over certain lands in the County of Hall and State of Nebraska as a part of the trust created and established under the last will and testa- ment of Isaac A.McCarty, Deceased, but that said lands were in the possession and control of the life tenant Ona B.McCarty, during the lifetime of the Deceased, Del Franklin McCarty, and the said Grand Island Trust Company never was in possession or control or had any interest in the legal title of the lands hereinafter described and their said trust terminated at the death of the Deceased Del Franklin McCarty and never became operative and the Deceased died possessed of an undivided one fifth interest in the real estate situate in the County of Hall and State of Nebraska, subject to the life estate of Ona B.McCarty, described as follows: Lots One (1), Four (4), Five (5), Six (6), Seven (7), Eight (8), and Nine (9) and the South Half (50 of the South West Quarter (SWU , and the South Half (S-2) of the South East Quarter ZOO), all in Section Twenty Six (26), Lots Nine (9), Ten (10), Eleven (11), and Twelve (12), and the South East Quarter (SE4) of the South East Quarter (SEJ); all in Section Twenty Seven (27), Lots Three (3), Four (4)., Five 5) and Six (6) and the South` Half (Si.) of the North East Quarter (NE J), and the-South Half SSS-210 of the North West Quarter (NWT), all in Section Thirt Four (34), and Lots One (1), Two t2), Three (3), Four -(4), and the North West Quarter (NW �, and the North Half (NJ) of the North East Quarter (NEJ), and the South West Quarter (SW) of the North East Quarter (NE4), all in Section Thirt Five (35), and all of the above described lands being in township Ten (10) North,Range Ln (10), West of the Sixth P.M. and containing Fourteen hundred thirty acres (1430) more or less according to the Government Survey, together with all and singular, the tenemants, heredita- ments and appurtenances thereunto belonging. The Court further finds that more than two years have elapsed since the death of the deceased, that he died intestate seized of an inheritance estate in the County of Hall and State of Nebraska, and that no administrator has been appointed in the State of Nebraska and that no decree of heirship has been entered in said estate in the State of Nebraska. The Court further finds that the heirs of the Deceased,.their degree of kinship, and their right of descent in the real property of which the Deceased died possessed, in the County of Hall and State of Nebraska, as hereinbefore described, are as follows: Grace L.McCarty, surviving widow, an undivided one third interest in the undivided one fifth interest of the Deceased or an undivided one - fifteenth interest in the lands hereinbefore described. Lea F.McCar�y,son; Willard H.MeCarty, son and Grace Del McCarty, daughter, each an undivided two - ninths interest in the one -fifth interest of the Deceased or a two - forty- fifths interest in the lands hereinbefore described, all subject -to the life estate of Ona B.McCarty. IT IS THEREFORE ORDERED ADJUDGED AND DECREED BY THE COURT that an undivided one- fifteenth interest in the lands hereinbefore descried, be assigned and set over unto Grace L.McCarty, surviving widow of the Deceased; that an undivided two -forty fifths interest in the lands here- inbefore described, be assigned and set over unto each of the following named children of the Deceased, Lea F. McCarty, Willard H. McCarty, Grace Del McCarty, said persons being all of the heirs of the Deceased and said lands being subject to the life estate of Ona B. *Carty.
