<br />I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on
<br />the 12th day of June, 1939, the instrument purporting to be the last will and testament of Emma
<br />Miller Luce deceased, was filed for probate in this Court. That on the 5th day of July, 1939,
<br />said instrument to which this certificate is attached was duly proved probated and allowed as the
<br />last will and testament of the real and personal estate of said Emma killer Luce deceased, and the
<br />same was ordered to be recorded in the records of the Court aforesaid.

<br />IN THE MATTER OF THE ESTATE OF D E C R E E
<br />EMMA MILLER LUCE, DECEASED. — — — —
<br />NOW on this 18th day of December, 1940, this cause came on for hearing upon the final report
<br />filed herein by Florence Cecelia Springsguth, executrix of the estate of Emma Miller Luce, deceased,
<br />and upon her application for the approval and allowance of said report, settlement of said estate
<br />and her discharge as executrix of said estate, and the Court having examined the records filed
<br />herein, including said report and vouchers thereto attached, and being fully advised in the premises
<br />finds as follows:
<br />That on the 12th day of June, 1939, Florence Cecelia Springsguth filed her petition in this
<br />Court in which she alleged, among other things, that Emma Miller Luce departed this life in Hall
<br />County Nebraska on the 7th day of June, 1939 leaving a Last Will and Testament in which Florence
<br />Cecelia Springsguth was named executrix thereof, which instrument she offered for probate as the
<br />Last Will and Testament of said deceased; and asking that an executrix thereof be appointed; that
<br />upon reading and filing of said petition this Court entered an Order fixing the time and place
<br />for hearing said petition and giving notice thereof as provided by law, and that said matter coming
<br />on to be heard upon the late fixed by the Court, said instrument was duly admitted to probate in
<br />this Court as the Last Will and Testament of said deceased and Letters of Administration were
<br />issued to the said Florence Cecelia Springsguth.
<br />That due and legal notice has been given to all persons of the time and place fixed by the
<br />Court for filing claims against said estate and all claims not filed within the time fixed by the
<br />Court, if any such therebe, should be forever barred, excluded and enjoined from setting up or
<br />asserting any such claims against said estate.
<br />That the deceased departed this life leaving as her heirs at law and only heirs at law, devisees,
<br />legatees and persons entitled to share in her estate the following named persons, to -wit: Charles
<br />Luce, widower, Florence Cecelia Springsguth, Peter John Miller and Phillip Wilbur Miller, all of
<br />legal age.
<br />That the deceased departed this life the owner in fee simple title in and to the following real
<br />estate situated in Hall County, Nebraska, to -wit:
<br />The West Forty -nine (W49) feet of a rectangular piece of ground One Hundred Eight (108) feet
<br />wide, being Four Hundred forty -nine (449) feet long, situated immediately North of Lots One
<br />(1), Twenty -six (26), Twenty -seven (27), of Hawthorne Place, being the tract described in a
<br />deed recorded in Book Forty -eight (48),Page One Hundred thirty -six (136) of the deed records
<br />of Hall County, said Hawthorne Place being a sub - division of part of the Northwest Quarter
<br />(NA) of Section Twenty -t,,ro (22), Township Eleven (11),Range Nine (9),West of the 6th P.M.,
<br />more particularly described as follows: Commencing at the Northwest (NW) Corner of the above
<br />described tract running thence South on the West line of said tract One Hundred Eight (108)
<br />feet, thence East on the South line of said tract Forty -nine (49) feet, thence North One Hun-
<br />dred Eight (108) feet to the North line of said tract, thence West on said North line Forty -
<br />nine (49) feet to the place of beginning, in Hall County, Nebraska, and
<br />A tract of ground describ -d as follows: Commencing at a point One Hundred Eight I09) feet North
<br />and Forty-nine (49) feet East of the Northwest'(NW) Corner of Lot One (1) of Hawthorne Place
<br />at a point on the North line and Forty -nine (49) feet East of the Northwest (NW) Corner of a
<br />tract of ground conve ed to Peter C.Hansen by warranty deed dated January 3, 1925 and recorded
<br />in Book Sixty -Six (6U, at Page Three Hundred Nineteen (319) of the records of Hall County,
<br />thence South on the East line of a tract of land conveyed to Emma Miller a distance of One
<br />Hundred Ei ht (108) feet, thence East Forty (40) feet on the North line of said above described
<br />Lot One (1 , thence North One Hundred Eight (108) feet to the North line of the Hansen tract,
<br />thence West Forty (40) feet to the place of beginning, in hall County, Nebraska.
<br />and the said real estate hereinbefore described did pass and descend under the terms of the said
<br />Last Will and Testament as follows: To Florence Cecelia Springsguth, Peter John Miller, and
<br />Phillip Wilbur Miller, equally, share and share alike, in fee simple title.
<br />That all of the claims filed in said estate have been paid and satisfied.
<br />That the final report filed herein is true and correct, in all things, and that the same should
<br />be approved and allowed as her final report in said estate, said estate settled and closed, said
