THEAUGUSi1NEC0. 20112 -2.41 <br />The Court further finds that the Executor has distributed said sum and that the persons entitled <br />thereto has filed receipts therefor. <br />The Court further finds that the said David Kaufmann, Executor, was the surviving spouse and <br />that he had a certain interest different from that which he received under the.last will and <br />testament, but that in consideration of the approval of the Final Report, waived the right which <br />he would have had as spouse, and that he was entitled to an Executor's fee, which he has likewise <br />waived. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the said David Kaufmann,Executor <br />be and he is hereby discharged as executor and his bond released and this estate finally closed. <br />The Court further finds that the said Celia Kaufmann at the time of her death was the owner of <br />Lot Five (5) in Block Twenty -two (22) in Charles Wasmer's Addition to the City of Grand Island, <br />Hall County, Nebraska, which was the home of the deceased and the said David Kaufmann at the time <br />of her death and at the time of the execution of her last will and testament on the 18t day of <br />April, 1937; that by order of court dated August 10, 1907, creditors of the deceased were allowed <br />six months from the 19th day of August, 1907, in which to file their claims with the pro -of- thereof <br />in the office of the County Judge of Hall County, Nebraska; that the time then allowed for,.filing <br />claims has long since expired; that notice was given to all persons of the time allowed and place <br />appointed for filing claims against said estate by posting and by publication as required by law; <br />that all claims filed and allowed against said estate have been fully paid and satisfied; that <br />all claims outstanding against said estate and not presented, if any there be are, therefore, <br />forever barred and excluded. <br />It is therefore Adjudged and Considered that all persons are forever barred from filing or <br />setting up any claims or demands against the estate of William C.Wingert, deceased, and said <br />estate is fully closed. <br />The Court finds that the said William C.Wingert left surviving him as his heirs at law, and <br />his only heirs at law, May B'.Wingert, his widow, and Cecil Clarence Wingert, his son. <br />The Court finds that the said William C.Wingert was at the time of his death the owner of <br />Blocks 4, 5, 8 and 9 in Robinson's Addition to the Village of Cairo; the S.W.J of Section 12, <br />in Township 12, in Range 12, the N•2 of the NEJ of section 13, in Township 12, in Range 12, and <br />J interest in Lot 10, in Block 10, in the Village of Cairo, all in Hall County, Nebraska, which <br />real estate dFscended under the law to said heirs and which has been sold by order of the District <br />Court of Hall County, Nebraska, to pay debts allowed against said estate. <br />
