<br />Adelheid Hilmer, also known as ) DECREE OF HEIRSHIP, DISTRIBUTION
<br />Mrs. William Hilmer, Deceased. ) AND ON FINAL ACCOUNT.
<br />Now, on this 26th day of February, 1943, this cause came on for hearing upon the petition
<br />of Albert Hilmer and Harry C.Hilmer, administrators of said estate, for a settlement of the
<br />estate of Adelheid Hilmer, also known as Mrs. William Hilmer, deceased on the final administra-
<br />tion account filed herein, which said account, together with the evidence, was suboitted to the
<br />court, and,
<br />It appearing to the court, from the proof on file, that notice of the pendency of said petition
<br />for final settlement and hearing on the final account has been given to all persons interested in
<br />said estate by publication in The Phonograph, a legal weekly newspaper printed, published and of
<br />general circulation in said county, three consecutive weeks prior to said date of hearing.
<br />Upon consideration whereof, the court finds:
<br />That, said deceased departed this life intestate at Boelus, Howard County, Nebraska, on the
<br />30th day of August, 1942; that the said Albert Hilmer and Harry C.Hilmer were duly appointed
<br />as administrators of said estate on the 16th day of October, 1942, and qualified as such by
<br />giving a bond and subscribing the oath required by law and the order of this court; that notice
<br />to creditors was duly and regularly given allowing said creditors until and including the 6th
<br />day of February, 1943, within which to file and present claims against said estate; that the
<br />time limited for filing claims as fixed by said notice and the order of this court has expired.
<br />That, the final account filed herein is true and correct in all respects and should be allowed
<br />as the final account of said administrators.
<br />That, there has come into the hands of the administrators of said estate the sum of $887.14
<br />which was all expended in paying the debts and costs of administering said estate, leaving no
<br />balance due said estate to be distributed to the heirs at law of said deceased.
<br />That, there remains in the hands of the administrators the following described personal
<br />property, to -wit:
<br />No. 2771 -166 Certificate of Title of the Grand Island Trust Company for an undivided 1120
<br />interest in the First Mortgage loan of $4,000.00 executed by John E.Johnson and Pearl V.
<br />Johnson on real estate described as follows; All of Section 22, in Township 17 N. Range 54,
<br />and all of Section 30, with the exception of the N2 of the NE 4 in Township 17 N., Range 53
<br />West of the 6th P.M. Banner County, Nebraska. issued to Mrs. William Hilmer, Sept. 20, 1933
<br />in the amount of $200.00;
<br />No. 2016 -125 Certificate of Title of the Grand Island Trust Company for an undivided 26/135
<br />interest in the First Mortgage loan of $1 ,500.00 executed by Jacob F.Fogelsong and wife
<br />on real estate described as follows.
<br />• SE j E! NE 4, S* of NE4 and SEI of NW I and Ej M4 of
<br />Section 32, also the SW14 of SDI of Section 33, all in Iwp. 17 North, Range 23 West of the-6th
<br />P.M., Custer County, Nebraska, issued to Adelheild Hilmer, who is also known as Adelheid
<br />Hilmer, February 27, 1933, in the amount of $2600.00;
<br />No. 288, Certificate of title of the Grand Island Trust Company for an undivided 2/55 interest
<br />in the First Mortgage Loan of $5500.00 executed by Lincoln G.Sell and Wife on real estate des-
<br />cribed as follows: S-1 of N2 of NE$ and S2 of N1- of NW4' and S� of NW; and NW4 of Section 22 and
<br />S21 of N1 of NW4 and S2 of NW14 and N144 of SW14 of Section 23, in Township 13,, N. Range 20 West
<br />of the tth P.M. Custer County, Nebraska, issued to Mrs. Wilhelm Hilmer, who is also known as
<br />Mrs. William Hilmer, May 21, 1936, in the amount of $200.00#,
<br />Participation No. 3210 of Mortgage Collection and Liquidation Certificate of Grand Island
<br />Trust Co. of Grand sland,Nebraska issued to Mrs. William Hilmer in the principal sum of
<br />$300.00 in the first mortgage loan No. 1756 of 43600.00 made to Mollie A.Edwards, a widow,
<br />and secured by land in Hall County, Nebraska, dated Jan. 7, 1939•
<br />Participation No. 2770 of Mortgage Collection and Liquidation Certificate of Grand Island
<br />Trust Co. of Grand IslandNebraska, issued to Mrs. William Hilmer, in the principal sum of
<br />$1,000.00 in the first mortgage loan No. 753 of 06,000.00 made to Laurine B.Hansen and H.C.
<br />Hansen, her husband, and secured by land in Greeley County, Nebraska, dated February: 13; 1935-
<br />all of ?which is to be distributed between the heirs at law of said Decedent, under the laws of
<br />the State of Nebraska.
<br />That, said deceased was at the time of her death the owner in fee of the following described
<br />real estate, to -wit:
<br />An undivided one -third (1 /3)'interest in Lot Five (5), Block A. of Boehm's Subdivision, an
<br />addition to the City of Grand Island,Hall County, Nebraska.
<br />which is to be distributed between the heirs at law of said decedent in accordance with the
<br />laws of descent and distribution of the State of Nebraska.
<br />That the funeral,1 xpe 'ses of the last sickness, costs of administration, and. all claims and
<br />demands against said estate have been fully paid, and there are no claims outstanding against said
<br />estate at this time.
<br />That, said estate, or the interest of any heir, is not liable for the assessment of any in-
<br />heritance tax, either federal or state.
<br />That, the sole and only heirs at law of said Adelheid Hilmer, also known as Mrs. V1111iam Hilmer,
<br />Deceased, are the following named children, to -wit: Albert Hilmer, son, and Harry C.Hilmer, son,
<br />both of full legal age; that said Decedent left no husband surviving, and no children of deceased
<br />children.
<br />That, the heirs at law of said deceased each have an undivided one -half (1) interest in the
<br />distribution of said estate.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT,
<br />That the final account filed herein on the 9th day of February, 1943, be, and the same hereby
<br />Is allowed and approved as the final account of said administrators.
<br />That all claims against said estate are forever barred.
<br />That said estate be, and the same hereby is, set over and assigned in accordance with the
<br />laws of descent and distribution of the State of Nebraska in the proportions herein found to the
<br />
