<br />Otto L.Mattke,deceased,and the Court thereupon fixed the 14th day of May 1941,as the date for
<br />making proof thereon,due and legal notice thereof was given,and on the 1�th day of May,1942,
<br />said instrument was duly proven,allowed,and admitted to probate in this Court as and for the last
<br />will and testament of Otto L.Mattke,deceased,and letters testamentary were duly issued - thereon
<br />to William Suhr and C.E.Grundy,executors as named in said will,and they duly qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for the filing of claims,that all claims filed against said estate have
<br />been paid, and the time fixed for filing claims has fully expired.
<br />IT IS,THEREFORE,ORD.&RED that all claims against said estate,if any such there be,and not filed
<br />herein,are fo rever barred and excluded.
<br />The Court further finds that Otto L.Mattke died seized as the owner in fee simple of the following
<br />described estate:
<br />The northerly one -half of Lot One (1) in Block Thirteen (13) in Kernohan & Decker's Addition to
<br />the city of Grand Island,in Hall County,state of Nebraska,
<br />The northerly one -sixth of Lot Eight (S) in Block Sixty -four (64),in the Original Town,now City,
<br />of Grand Island,in Hall County,Nebraska,
<br />All of which was devised to Arthur Ilattke,Matgaret Grundy, and Edward Mattke, sons and dai *firer of
<br />said Otto L.Mattke,deceased,share and share alike,subject to the life estate therein of Stacia
<br />Mattke, surviving widow of said Otto L.Mattke, deceased.
<br />The Court further finds that the Executors have paid the inheritance tax,have paid special legacies
<br />to Arthur Mattke and Margaret Grundy,and have paid to William Suhr and C.E.Grundy,as trustees for
<br />Edward Mattke,the special legacy in his favor,and have paid and delivered and transferred to
<br />William Suhr and C.E.Grundy,as trustees for Stacia Mattke,surviving widow of said Otto L.Mattke,
<br />deceased,during her lifetime, all the property,real and personal,remaining in the hands of said
<br />executors,all in accordance with the last will and testament of said Otto L.Mattke,deeeased, and
<br />under order of this Court.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that the real estate described as follows:
<br />The northerly one -half of Lot 1 in Block 13 in Kernohan & Decker's Addition to the city of Grand
<br />Island,in Hall County,Nebraska,and The northerly one -sixth of Lot Eight (S) in Block Sixty -four
<br />(64) in the Original Town,now City of Grand Island,in Hall County,Nebraska.
<br />passed and descended,under said last will and testament,to Arthur Mattke,Margaret Grundy,and
<br />Edward Mattke,a one -third each,all subject to the life estate and use thereof by Stacia Mattke,
<br />surviving widow,under the terms of said last will and testament.
<br />The Court finds that said Executors have delivered to said Trustees,William Suhr and C,E.Grundy,
<br />the sum of $5000.00 to be held in trust for the use and benefit of Edward Mattke until he reaches
<br />the age of thirty years.
<br />This cause came on further to be heard,and the Court finds that the executors have delivered to
<br />C.E.Grundy and William Suh.r,as trustees,the property,real and personal,set out in the receipt and
<br />inventory of said trustees filed herein,that the said trustees have filed herein their bond as
<br />such in the sum of $50,000.00,which is hereby approved,
<br />IT IS THEREFORE,ORDERED,ADJUDGED AND DECREED BY THE COURT that the final report of said executors
<br />be,and the same is hereby,approved and allowed as their final report,and said estate is hereby
<br />settled and closed and said executors discharged from their bond as such executors and hereby
<br />released.
<br />IT IS FURTHER ORDERED BY THE COURT that said Trustees perform and execute their duties as trustees
<br />as in the last will and testament of Otto L.Mattke provided,and that they make annual reports
<br />to the Court,and do and perform any and all acts necessary under said trust.
