<br />WILL AND DECREE:
<br />LAST WILL AND TESTAMENT OF OTTO L.MATTKE
<br />I,Otto L.Mattke,of Grand Island,Hall County, Nebraska, being of sound mind and disposing memory,
<br />do make and publish this,my last will and testament,in the manner and form following,that is to
<br />say: FIRST.
<br />I direct that my just debts,if any,and the expenses attending my burial,and a suitable provision
<br />for perpetual care of our cemetery lot,be first paid out of my personal estate.
<br />SECOND.
<br />I give to my children,Arthur Mattke,Margaret Grundy,and Edward Mattke,the sum of Five Thousand
<br />Dollars ($5000.00) each,However,payment shall not be made to my son,Edward Mattke,until he reach-
<br />es the age of thirty years,and my executors,hereinafter named,shall invest said sum for him and
<br />pay him the interest or income therefrom annually,
<br />THIRD.
<br />I give, devise, and bequeath to my beloved wife, Stacia Mattke, the use, rents, income and profits from
<br />all the rest of my estate,both real and personal,and so much of my personal property as may be
<br />necessary,in addition to the aforesaid,for her care and comfort,during her natural life,and I
<br />further direct that all of said property shall be held and managed by my executors hereinafter
<br />named for the purposes provided for in this paragraph.
<br />FOURTH.
<br />Subject to the life estate bequeathed to my wife in the preceding parapraph hereof,I give,devise,
<br />and bequeath all of the rest,residue,and remainder of my estate to my children,Arthur Mattke,
<br />Margaret Grundy,and Edward Mattke,share and share alike,the children of any deceased child to take
<br />by right of representation,and the share of my son,Edward Mattke,to be held by my executors,
<br />hereinafter named,until he reaches the age of thirty years,said executors to manage said share
<br />of Edward Mattke until such time.
<br />FIFTH.
<br />I hereby nominate and appoint my son- in- law,C.E.Grundy,and William Suhr,as executors and trustees
<br />of this will,hereby granting to them,as such trustees and executors,full power and authority to
<br />sell and convey real estate without obtaining further order of court therefor.
<br />IN TESTIMONY WHEREOF,I have hereunto set my hand this 10 day of March 1936.

<br />I,Paul N.Kirk,Judge of the County Court,in and for said County,do hereby certify that on the
<br />21st day of April 1941,the instrument purporting to be the last will and testament of Otto L.
<br />Mattke deceased,was filed for probate in this Court.That on the 14th day of May 1941,said instru-
<br />ment to which this certificate is attached was duly proved,probated and allowed as the last will
<br />and testament of the real and personal estate of said Otto L.Mattke deceased,and the same was
<br />ordered to be recorded in the records of the Court aforesaid.

<br />Otto L.Mattke, Deceased.
<br />Now,on this 20th day of February,1943,this cause came on for hearing upon the final report of
<br />William Suhr and C.E.Grundy,executors of the last will and testament of Otto L.Mattke,deceased,
<br />and upon their petition for settlement of said estate,said hearing having been continued from
<br />the 2nd day of September,1942.
<br />The Court,having examined said report and the records and files in said estate,and being -;;duly
<br />advised,finds that due and legal notice has been given to all persons interested in said estate
<br />of the time and place fixed for hearing upon said final report,as heretofore ordered by the
<br />Court,and no one appearing to object,the Court examined the same,together with the vouchers on
<br />file andtestimony in support thereof,and being duly advised,finds said report trueand correct
<br />in all things and that said report should be approved and allowed as and for the final report
<br />of said executors.
<br />The Court finds that said Otto L.Mattke departed this life on the 13th day of Apri1,1941,and
<br />at the time of his death he was a resident and inhabitant of Hall County, Nebraska; that a petit-
<br />ion was filed in the County Court of Hall County, Nebraska, on the 21st day of April, 1941, praying
<br />for the allowance and probate of an instrument purporting to be the last will and testament of
