<br />WILL AND DECREE
<br />LAST WILL AND TESTAMENT OF HERMAN WIESE
<br />KNOW ALL MEN BY THESE PRESENTS: That I, Herman Wiese, of Grand Island, Hall County, Nebraska,
<br />being of full age and sound and disposing mind and memory, do hereby make, ordain and declare this
<br />to be my last will and testament, hereby revoking and annulling any and all other wills which I
<br />may have heretofore made.
<br />FIRST
<br />I direct that my Executrix, hereinafter named, shall pay all of my just debts and the expenses
<br />incident to my death, and the administration of my estate, from my personal property as soon after
<br />my death as may be convenient.
<br />SECOND
<br />I do hereby give, devise and bequeath all of
<br />personal, and wherever the same may be situated,
<br />ebraska, absolutely and in fee simple.
<br />THIRD
<br />the rest and residue of my estate, both real and
<br />unto my wife, Anna Wiese, of Grand Island,
<br />I do hereby nominate and appoint the said Anna Wiese to be the Executrix of my estate, and
<br />direct that no surety shall be required upon her official bond as such.

<br />At a Session of the County Court held in the County Court Room in Grand Island, in said
<br />County, on the 8th day of August, A.D., 1940.

<br />Herman Wiese, Deceased.
<br />I, Paul N. Kirk, Judge of the County, Court, in and for said County, do hereby certify that on
<br />the 17th day of July 1940, the instrument purporting to be the last will and testament of Herman
<br />Wiese deceased, was filed for probate in this Court. That on the 8th day of August 1940, said
<br />instrument to which this certificate is attached was duly proved probated and allowed as the
<br />last will and testament of the real and personal estate of said kerman Wiese, deceased, and the
<br />same was ordered to be recorded in the records of the Court aforesaid.

<br />Herman Wiese, Deceased. )
<br />This cause came on for hearing upon the final report and petition for settlement of Anna Wiese,
<br />executrix, and upon her application for discharge,
<br />The Court, having examined said report and the records and files in said estate, and being duly
<br />advised in the premises, finds that due and legal notice has been given to all persons interested
<br />in said estate of the time and place fixed for hearing upon said final report, as heretofore ordered
<br />by the Court, and no one appearing; to object to said report, the Court examined the same, together
<br />with the vouchers on file and testimony in support thereof, and being duly advised, finds that said
<br />report is true and correct in all things and ought to be approved and allowed as and for the final
<br />report of said executrix.
<br />The Court finds that said Herman Wiese died on the 9th day of July, 1940, and at the time of
<br />his death he was a resident and inhabitant of Nall County, Nebraska.
<br />The Court finds that on July 17th, 1940, a petition was filed herein, praying for the allowance
<br />and probate of an instrument purporting to be the last will and testament of Herman Wiese,deceased,
<br />that the Court thereupon fixed the 8th day of August, 1940, as the date for making proof of said
<br />last will and testament, and due and legal notice of the filing of said petition and of the time
<br />and place fixed for the hearing thereon was given by the Court, as provided by law, and on said
<br />date, August 8, 1940, said instrument was duly proven, allowed, and admitted to probate in this
<br />Court as and for the last will and testament of Herman Wiese, deceased, and letters testamentary
<br />were duly issued thereon to Anna Wiese, executrix as named in said last will and testament, and
<br />she thereupon qualified as such.
<br />The Court further finds that due and legal notice has been given to all persons of the time
<br />and place fixed by the Court for the filing of claims against said estate, that said time has
