THEAUGUSTIHECO. 20112.2.41 In the Matter of the Estate of Henry Schuett, Deceased. I, Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on the 22nd day of July, 1942, the instrument purporting to be the last will and statement of Henry Schuett, deceased, eras filed for probate in this Court. That on the 19th day of August, 1942, said instrument to which this certificate is attached was duly proved, probated and allowed as the last will and testament of the real and personal estate of said. Henry Schuett, deceased, and the =.ame was ordered to be recorded in the records of the Court aforesaid. IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, this 19th day of August, 1942. (SEAL) Paul N.Kirk, County Judge The Court further finds that said Lena Schuett named in said Will, was upon her giving bond in the sum of $5,000.00 as ordered by this Court, appointed Executrix of said estate as prayed and Letters Testamentary were issued to her by this Court on August 2q, 1942, granting her one year in which to settle said estate; the Court further fines that the deceased, at the time of his death was a married man, and.. that he left the following heirs -at -law: Lena Schuett, his widow, Galen Claus Schuett, a son, all over the age of 21 years, and Leland Henry Schuett, a son of the age of 13 years. FOURTH That on the 20th 0ay of August, 1942, an order of this Court was made allowing creditors three months from and after the 16th day of September, 1942, in which to file their claims with proof there-f, in the office of the County Judge of Hall County, Nebraska, and fixing a time for hearing on claims filed against said estate on December 19, 1942, at 9 o'clock A.M. before the County Court of Hall County, Nebraska, and further ordering that notice of the same be given to all persons interested by publishing such notice for three successive weeks prior to September 16, 1942, in the Grand Island Independent, a legal newspaper published and circulating in Hall County, Nebraska, and it appears by proof on file that notice of -,,-,-id order was published as ordered by this Court. FIFTH. The Court further finds that on the 30th day of December, 1942, the said Lena Schuett as Executrix, filed in this Court her inventory of the property of said estate, and that according to said inventory, the deceased died seized and possessed of the following described property, to =wit: An undivided one -half interost in the Southwest Quarter (SW4) of Section One (1) in Township Twelve (12) North,Range Twelve,West of the 6th P.M., in Hall County, Nebraska. Chattel property listed in said inventory of the value of $3570.00 and cash in the State Bank of Cairo of Cairo, Nebraska, in the sum of $150.00 SIXTH. The Court further finds that according to the terms and conditions of said Last Will and Testament, said property was devised and bequeathed unt said Lena Schuett in fee simple absolute. SEVENTH. The Court further finds that on the 19th d.ay of December,.1942, an order of this Court was made barring all claims not filed against said estate; that all debts and claims against said estate and the costs of administration in said estate, have been fully paid and distribution of said estate made according to said Last Will and Testament and inhere remains no money or property In the hands of said Executrix undisposed of. EIGHTH The Court further finds that after deducting costs of administration, other proper expenditu widow, devisees and legatees, that there is due Nebraska, no inheritance tax whatsoever, and no from the assets of said estate, all debts, claims, res and the statutory exemptions allowed said and payable to the County Treasurer of Hall County, estate tax is due the United States of America. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of Lena Schuett as Executrix of said estate be and the same is hereby approved and allowed as such; further that Lena Schuett, his widow, Galen Claus Schuett, his son, and Leland Henry Schuett, his son, are all and the only heirs -at -law of said Henry Schuett, deceased, and that the property described in paragraph Fifth hereof, ��assed under said Last Will and Testament as found in paragraph 6th of this decree; that settlement of said estate has been completed and distribution made in full according to said Last Will and Testament and that said Executrix has fully discharged all of her duties and obligations as such and is therefore hereby granted a discharge as Executrix, and her bond released.
