<br />At a session of the bounty Court held in and for said County of Hall the 27th day of January,
<br />1943, present Paul N.Kirk, County Judge:
<br />BE IT REMEMBERED that on the 30th da.y of December, 1942, Lena Schuett, Executrix of the Estate
<br />of Henry Schuett, deceased, filed in this Court her final account as such Executrix and a petition
<br />praying that said account be allowed; for decree of heirs - -ip, order of distribution and final
<br />settlement thereon and discharge.
<br />For these purposes the 27th day of January, 1943, at 10 o'clock A.M. at the County Court
<br />Room in said County was assigned as the time and place for hearing said petition, examining and
<br />allowing said account; and it was ordered that notice of the pendency of said petition and the
<br />hearincr thereof be given to all persons interested in said matter by publishing such notice in the
<br />Grand island Independent, a legal newspaper printed in said County, for three weeks prior to said
<br />day of hearing; and it appears by proof on file that said notice was given as ordered by Court
<br />and no objections have been made or filed thereto, and that the same should be allowed.
<br />Upon an examination of the record and the evidence in this matter and being duly advised
<br />in the premises, the Court finds as follows:
<br />FIRST
<br />That Henry Schuett departed this life on the 16th day of July, 1942, in Hall County, Nebraska,
<br />testate, and tiat at t-ie time of his death he was a resident of Hall County, Nebraska.
<br />SECOND.
<br />That on ti-le 22nd day of July, 1942, Lena Schuett filed an instrument puri)orting to be the
<br />Last Will and Testament of said Henry Schuett, deceased, in this Court and a petition offering said
<br />Will for probate, wherein said Lena Schuett was named Executrix; and on the 22nd day of July,1942,
<br />an order of this Court was made therein, assigning the 19th day of August, 1942, at 10 o'clock A.M.
<br />at the County Court Room in said County, as thie time and place for hearing said petition and
<br />proving said Will, and ordering that notice of the pendency of said petition and the hearing
<br />thereof be given to all persons interested in said matter by publishing a copy of said order in
<br />the Grand Island Independent, a legal newspaper printed in said County, for three successive weeks
<br />prior to said day of hearing, and it appears by proof on file that notice of said order was given
<br />a.s ordered by this Court.
<br />THIRD.
<br />The Court further finds that at said time and place, said Will was duly proven and allowed
<br />and admitted to probate, which Will in words as follows:
<br />LAST ,TILL AND TESTAMENT OF HENRY SCHUETT
<br />I, Henry Schuett, of Cairo, County of Hall, and State of Nebraska, being of sound mind and
<br />disposing memory, do make, publish and declare this to be my Last Will and Testament, hereby
<br />revoking all former-wills and testamentary instruments by me made.
<br />1. I order and direct that my Executrix shall pay aLl of my just debts and funeral expenses as
<br />soon after my decease as conveniently may be.
<br />2. After the payment of such debts and expenses, I give, devise and bequeath unto my wife, Lena
<br />Schuett, all of the rest, residue and remainder of my estate, both real and personal, of every
<br />kind and nature and wheresoever siti.,.ated, to have the same absolutely.
<br />LASTLY, I hereby nominate and appoint my wife, Lena Schuett, as Executrix of this Will.
<br />IN WITNESS WHEREOF, I have hereunto set my hand this 1st day of AuUist, 1932.

<br />This instrument was on the day of tre date thereof, signed, published and declared by the said
<br />Henry Schuett to be his last Will and Testament in t.�e presence of us who at his request have
