During my wife s lifetime she shall have the income from everthing I own, also the use of the House, ancy all the Household goods, After her dead sell everthing what you dont persona, -_ly want, and divide everything 1/4 to Walter Raecke, 1 to Frieda Bestian 1/4 to Otto Raecke 1 /8to Elvira Ferguson and 1/8 to Dorothy Ferguson, Elvira and Dorothys Share shall be kept for them till Jan. 15 - 1940, that is in case my wife should not be living at that time. My children dYall make provision for the upkeep of our burial lot at the cemetery in Chapman. My wifes name is Hedwig J. Raecke. My Wife and my Children shall be Executors of my Will. I Paul N.Kirk, Judge of the County Court, in and for said County, do hereby certify that on the 4th day of February, 1942, the instrument purporting to be the last will and testament of Robert J.Raecke deceased, was filed. for probate in this Court. That on the 26th day of February 1942, said instr7_tment to which this certificate is attached was duly proved, probated and allowed as the last will and testament of the real and personal estate of said Robert J.P.aecke deceased, and the same was ordered to be recorded in the records of the Court aforesaid. That due and legal notice as required by law and the order of this court has been given to all persons interested in the estate of Robert J.Raecke, deceased, of the hearing on the petition for ap?roval of the final account, for an order of distribution, and for closing of administration, and that no objections thereto have been filed. 11. That due and legal notice for the filing of claims as provided by law and the order of this court has been given and that all claims allowed have been paid and that all claims not filed have been barred by legal and proper order of this court, and that the funeral bill has been paid. 111. That there is no inheritance tax, income tax, or estate tax due the State of Nebraska nor the United States Government nor chargeable against said estate or any interest therein or any portion thereof. iv. That on the 23rd day of December, 1942, the executor filed his final report of his receipts and disbursements as such executor, and on this 16th day of January, 1943, filed a supplemental report, and tr--at he has accounted for all property which has come into his hands or under his control, and that the charges of said executor for disbursements are just and legal charges, and that said reports show that said executor has on hand the sum of One Hundred Eighty -seven and 53/100 Dollars ($187.53) for distribution, and that the bonds and certificates for shares of stock described in the inventory are still on hand. V. That Robert J.Raecke died testate, and tA.at his Last Will and Testament has been duly admitted to probate; that he left surviving him as his sole and only heirs at law and devisees and legatees the following: Hedwig J.Raecke, his widow, Walter R.Faecke, a son, Frieda J.Bestian, a daughter, Otto A.Raecke, a son, Elvira Dey-ter, nee Ferguson and Dorothy Hobbs, nee Ferguson, gra.nddaught. ers, the said granddaughters being the children of a predeceased daughter; that under the terms and provisions of said. will the use and income of all of his property, both areal and personal, is devised and bequeathed to his widow, Hedwig J.Raecke, for and during the term of her natural life, and after her death all of the rest and residue is devised and bequeathed as follows: To Walter R.Ra.ecke one - fourth (1/4), to Frieda J.Bestian one - fourth (1/4), to Otto A.Raecke one - fourth (1/4), to Elvira Dexter one - eighth (118) and to Dorothy Hobbs one - eighth (1/8) V1. That Robert J.Raecke, deceased, died seized of the following described real estate situated in Hall County Nebraska: Lot One ti), Block Trio (2), Win &olph `Adds ti6A to Grand Island, Nebraska. Vll. That the expenses of administration have been paid and that the residue of cash on hand in the sum of One Hundred Eighty -seven and 53/lO0 Dollars ($187.53) has been derived solely from income from the personal property of sn.id estate and that therefore the widow, Hedwig J.Raecke, is entitled to the same. IT IS THEREFORE CONSIDERED, ORDERED AND DECREED by the court that the accounting of the executor be and hereby is approved; that he be and hereby is authorized to distribute the money on hand in the sum of $187.53 tc the said Hedwig J.Raecke; that the life use and income from all of the property of said estate is devised and bequeathed and is hereby assigned to the said Hedwig J.
