<br />and place fixed by the Court for filing, claims against the estate of the deceased, and that the
<br />time so fixed has fully expired, and that all persons having claims against said estate, and not
<br />filed within the time limited by the Court, are forever barred and excluded from setting up or
<br />asserting any such claims ,,gainst the said estate.
<br />The Court further finds that all funeral expenses of the deceased, all debts against the estate
<br />and costs of these proceedings and t",-at distribution of all remaining assets has been made nursunnt
<br />to the terms and provisions of said `dill.
<br />The Court further finds that the estate of said deceased was not subject to an inheritance
<br />tax under the laws of the State of Nebraska nor to a Federal Estate Tax 'ender the laws of the
<br />United States.
<br />The Court further finds that the said William Luth died seized as the owner, by fee simple title
<br />of the following described real estate all located in Hall County, Nebraska, to -wit:
<br />Lot Seven (7), Block 'shirty -one (31) in Russel Wheeler's Addition to the City of Grand
<br />Island, Hall County, Nebraska.; and
<br />The West Half of the Southwest Quarter (Wz SW4) and the West 10 acres of the Northeast
<br />Quarter of the Southwest Quarter (NE 1411) and the South 51 rods of the Southeast Quarter
<br />of the Southwest Quarter (SE4 SW4) of Section Seven (7), Township Ten (10),Range Ten (10)
<br />West of the 6th P.M., Hall County, Nebraska.
<br />The Court further finds that the real estate described as the Southeast Quarter of the North-
<br />east Quarter (SEJ NE4) of Section Fifteen (15), Township Ten (10),Range Ten (10),Hall County,
<br />Nebraska, and referred to in the Last Will and Testament of William Luth, deceased, was owned
<br />by him and Dora Luth as joint tena.,.ts and not as tenants in common with full title vesting in
<br />the survivor upon the death of either, and that the provisions in said Will intended to make
<br />disposition thereof are ineffective, title thereto having vested in Dora Luth in entirety as
<br />survivor.
<br />The Court farther finds that the said William Luth, deceased, left surviving him as his heirs-
<br />at-law and only heirs -at -law the following named persons, to -wit:
<br />Dora Luth, widow, Helen Fenton, Elsie Lilienthal, and Minnie Bruhn,daughters, and Lawrence
<br />Luth, Clarence Luth and Billie Luth,sons, all of whom are of legal age except Billie Luth.
<br />The Court further finds that the real estate hereinabove described except that portion in
<br />which he owned an interest as a joint tena:t, passed and descended under the terms and provisions
<br />of.the Last Will and Testament of William Luth,deceased, to Dora Luth for the during her natural
<br />lifetime she to have the use thereof and all rents and income therefrom so long as she lives and
<br />to pay all taxes and upkeep thereon and that s�)bject to her life interest therein the real estate
<br />described as Lot Seven (7), Block Thirty -one (31 in Russel Wheeler's Addition to the City of
<br />Grand Island, Hall County, 'lebra.ska, passed and descended to Lawrence Luth, subject however to
<br />charges thereon of $200.00 each to be paid to Helen Fenton, Elsie Lilienthal and Minnie Bruhn
<br />within ninety days after the death of Dora Luth and the real estate described as the West half
<br />of the Southwest Quarter (W ?SW4) and the West 10 acres of the Northeast Quarter of the Southwest
<br />Quarter (NE4SW4) and the south 51 rods of the Southeast Quarter of the Southwest Quarter (SE4 SW4)
<br />of Section Seven (7), Township Ten (10), Range Ten (10) '.hest of the 6th P.M., Hall County, Nebraska,
<br />passed and descended to Clarence Luth, subject however to charges thereon of $300.00 each to be
<br />na..id to Helen Fenton, Elsie Lilienthal and Minnie Bruhn within ninety days after the death of Dora
<br />Luth.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of Charles
<br />Luth, Executor of the Estate of William Luth, deceased, be, and the same hereby is, in all things,
<br />approved and allowed as the Final Report of the Executor, and said estate is hereby settled and
<br />closed and said Executor discharged.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />said. estate, if any such there be, are forever barred, enjoined. and excluded from setting up or
<br />asserting any such claims against said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY TAE COURT, that the real estate hereinabove
<br />described and owned in fee simple title by the said William Luth at the time of his death passed
<br />and descended as in the Last Will and Testament of said William Luth, deceased, provided and
<br />as hereinabove set forth.
