THEAUGUSTINECO. 20112.2.41 <br />WILL AND DECREE <br />IN THE NAME OF GOD, AMEN <br />I, William Luth of Alda in the County of Hall, State of Nebraska., being of sound mind and memory <br />and considering the uncertainty of this frail and transitory life, do therefore make, ordain, pub- <br />lish and declare this to be my last WILL AND TESTAMENT. <br />FI=ST, I order and direct that my Executor hereinafter named pay all my just debts and funeral <br />expenses as soon after my decease as conveniently may be. <br />SECOND, After the payment of such funeral expenses and debts, I give, devise and bequeath all <br />remaining personal property to my wife Dora Luth and in addition thereto a life interest in all <br />real estate of which I die seized, she to have the use thereof and all rents and income from the <br />same so long as she lives and pay all taxes a.nd, upkeep on the same. Subject to her life interest <br />I give, devise and bequeath Lot 7, Block 31 in Russel Wheelers Add. to Grand Island,Hall County, <br />Nebraska, to my son Lawrence Luth to have and to hold the same forever; provided, however, he <br />shall pay my daughters Helen Fenton, Elsie Lillenthal and Minnie Bruhn the sum of 4200.00 each <br />within ninety days after the death of my Wife. Subject to my wife's life interest h give, devise <br />and bequeath the W2SW4 and the west 10 acres of the NEj SW4 and the south 51 rods of the SE4SWJ of <br />Sec. 7, Township 10, Range 10, Hall County, Nebraska, to my son Clarence,Luth to have and to hold <br />the same forever; provided, however, he shall p'ay my three daughters herein 'named the sum of ` <br />$300.00 each within ninety days after the death of my wife. Subject to my wife s life interest I <br />mive, devise and bequeath the SE4 NE4 of Section 15, Township 10, Range 10, Yilest of the 6th P.M., <br />ball County, Nebraska, to my son,Billy Luth to have and to hold the same forever; provided, how- <br />ever, he shall pay my three daughters herein named the sum of $200.00 each within ninety days after <br />my wife's death. The provisions for cash pgymentsto my daughters shall be liens on the respective <br />properties until pad and not against any other property and shall be payable to said daughters or <br />their heirs. At a Session of the County Court held in the County Court Room in Grand <br />Island, in said County, on the 26th day of August, A.D., 1942. <br />Present Paul N.Kirk, County Judge. <br />In the Matter of the Estate of <br />William Luth, Deceased. <br />I Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on <br />the 4th day of August, 1942, the instrument purporting to be the last will and testament of <br />William Luth deceased, was filed for probate in this Court. OF THE ESTATE ) <br />OF ) FINAL DECREE. <br />WILLIAM LUTH, DECEASED ) <br />Now on this 20th day of January, 1943, this cause came on for hearing upon the final report of <br />Charles Luth, Executor of the Estate of William Luth, deceased, and upon the petition of said Execu- <br />tor for the allowance and approval of said report, the settlement of said estate, and discharge <br />herein as Executor, and the Court, having examined the records and files herein, and being fa.11y <br />advised in the premises, finds that due and legal notice has been given to all persons of the time <br />and place fixed by the Court for the hearing upon said Final Report, and no one appearing to object <br />U0 said Final Report, and the Court, having examined the same, and all preliminary reports, together <br />with the vouchers on file, finds that said report is true and correct in all things and that the <br />same ought to be a- onroved and allowed as and for the Final Report of said Executor, said. Estate <br />closed and said Executor discharged. <br />The Court further finds that the said William Luth departed this life en the 30th day of July, <br />1942, in Hall County, Nebraska, and that at the time of his death he was a resident and inhabitant <br />of Hall County, Nebraska, and left a Last Will and Testament, which was, by the consideration of <br />this Court, duly proven, allowed and admitted to probate on'the 26th day of August, 1942; that in <br />said Will he named Charles Luth as Executor and upon consideration by the Court the said Charles <br />Luth was duly appointed Executor of the Estate of William Luth, Deceased, and Letters Testamentary <br />were duly issued to him by this Court. <br />The Court further finds that due and legal notice has been given to all persons of the time <br />1 <br />C <br />1 <br />C� <br />
