<br />County, Nebraska, both being of sound mind and disposing memory,hereby make our joint and mutual
<br />will in manner and form following,that is to say:
<br />FIRST. T.11le first to die ('Ii� ,ects tiiat his or her funeral expenses, just debts and t-rie costs and
<br />expenses of administering _111s or her estate be first paid.
<br />SECOND. The first to die hereby gives, devises and bequeaths to the survivor, absolutely and for-
<br />ever, the remainder of his or her estate,both real and personal,after the payment of the obligat-
<br />ions referred to in paragraph one hereof.
<br />THIRD. In case the joint makers of t1lis will should die at or about the same time,or in case the
<br />survivor should not live long enough to probate the will of the first to die, then and in such
<br />case the joint makers of this will ilereby direct and make the following distribution of their
<br />property and of the property of each of t1i.-Iem,to-wit: To our four c1iildren,William, Frederick,Irma
<br />Arline,Anita Dorothy and Marian Helen,all of our property,whether real,personal or mixed,to be
<br />divided share and share alike.
<br />FOTJTRTH.In t.he event that paragraph "THIRD" of,this will and testament shall take effect,we hereby
<br />declare it to be our intention that any living children of any of our four children who might
<br />redecease us shall stand in t ,
<br />he stead Of our deceased child and shall inherit under the terms

<br />without leaving issue, it is our intention that t.*11e shabe of ti:at deceased child shall lapse, and
<br />shall be divided. share and share alike amonc, those children or their issue entitled to it by the
<br />terms of paragraph "THIRD".
<br />FIFTH. We hereby revoke all former wills made by either of us and join in the appointment of
<br />CHARLES WINTER, SR. ,brother of John Winter, as executor of this will,who shall act in any and all
<br />of the contingencies referred to above.

<br />NOW on this 23rd day of DecemCer,1942,this natter came on to be heard on the final account, and
<br />petition for settle-ment of final account and discharge of Caroline Winter,-Administratrix C.T.A.
<br />of the Estate of John Winter, deceased,and for the distribution of the personal property of said
<br />estate, ttil e assigrrpent of t1ne real estate of said estate,and t1ie evidence in support thereof,and
<br />said matter vvas submitted to tiae Court; on consideraion walilereof, the Court finds that due and legal
<br />notice of the time and place of hearing on said final account and petition for discharge has been
<br />given to all persons interested in said estate,as provided by law.
<br />Thereupon,tHe Court,being fully advised in the premises,finds as follows:
