<br />Now, on this 9th day of January, 1943, this cause came on for hearing before the Court upon the
<br />final account of Claude A.Davis, Executor, and his petition for distribution and the evidence duly
<br />introduced, the Court, being fully advised, finds that no objections have been filed to the said
<br />account or petition for distribution; finds that the account of the said executor is true and correct
<br />and ought to be ap,-)roved and confirmed by the Court.
<br />The Court further finds that since the date of said account the said Executor has received from
<br />certificates of deposit the additional sum of $2346.00, and that he has expended and distributed
<br />the following amounts:

<br />The Court further finds that there is still due to the said estate the sum of about $69.30
<br />from the Agricultural Adjustment Administration and certain rentals upon the real estate f-or the
<br />ear 1942, and that from said amounts, when received, the Executor should reimburse the sum of
<br />451.02 on account of the excess of expenditures over receipts, as aforesaid, and should pay the
<br />income tax, if any, due and chargeable to said estate, and distribute the remainder thereof to
<br />Claude F.Baker, the residuary legatee. That the said Executor be, and he is hereby, authorized
<br />and directed to assign and deliver to the said Claude F.Baker the remaining certificates of
<br />deposit in the total principal sum of $3500.00, a part of the residue of said estate.
<br />The Court finds that the assets of said estate hate been duly appraised and the amount of
<br />inheritance tax determined by order of the Court, and that said tax has been paid as follows:
<br />Chargeable to legacy of Harry Patterson - - - - - 440.00
<br />Chargeable to legacy of Claantha Baker, - - - - - $80.00
<br />Chargeable to residue - - - - - - - - - - - - - - - 385.52
<br />TOTAL - - - - - 505.82
<br />The Court further find -s that court costs have been fully paid, that a reasonable fee for the
<br />executor is the sum of $250.00 and for the attorney for the said estate is the sum of $350.00, and
<br />that said amounts have been paid.
<br />The Court further finds that the legatee, Claantha Baker, died prior to the death of Mary F.
<br />Blythe, and that the only child of said Claantha Baker,was the said Claude F.Baker, to whom said
<br />legacy became payable. That the said Claude F.Baker has duly assigned said legacy as set forth
<br />in the petition for distribution and that said legacy has been paid to the assigneesthereof, as
<br />above set forth.
<br />The Court further finds that all proceedings have been had for the filing and allowance of
<br />claims against said estate, that a time and place has been duly fixed by order of Court for
<br />presenting claims, and due notice thereof given to creditors and all persons interested in said
<br />estate, that said time has expired, that all claims filed have been paid, and all debts, claims,
<br />and demands, of every character against said estate, not so filed, or paid, are hereby forever
<br />barred and foreclosed.
<br />The Court finds that Mary F.Blythe departed this life on July 15, 1942, being a resident and
<br />inhabitant of Hall County, Nebraska, and leaving a last will and testament, and codicil thereto,
<br />which have been duly admitted to probate. That all personal property specifically bequeathed by
<br />said will and codicil has been delivered to the legatees thereof, and all cash legacies have been
<br />fully paid, after deducting inheritance tax chargeable thereto, and the said Executor S authorized
<br />and directed to deliver to the makers thereof the notes of Claude F.Baker and of Harry Patterson,
<br />as described in said account and uetition for distribution.
<br />The said. Mary F.Blythe died seized of the north forty -one feet of .Lot 14, Block 2, Fifth
<br />Addition to Cairo, Hall County, Nebraska, ianich real estate has been duly sold by the said Executor
<br />under the terms of said last will and testament, and proceeds thereof duly accounted for.
<br />The said Mary F.Blythe also died seized of the northwest quarter of Section thirty -two (32),
<br />township twelve (12) North,range eleven (11) West of 6th P.M., in Hall County, Nebraska, which, by
<br />the terms of said last will and testament, and codicil thereto, was'deivered to Claude F.Baker,
<br />of Bakersfield, California, in fee simple.
<br />IT IS, THEREFORE, ORDERED AND DECREED BY THE COURT that the final account of the said Executor
<br />be, and the same is hereby, approved and confirmed, and that upon the filing of vouchers for the
<br />payments made by him, and upon payment and delivery of all remaining assets as shown herein, to-
<br />gether with any assets of said estate which may hereafter be discovered and come into his possession,
<br />to the said residuary legatee, Claude F.Baker, then the said Executor shall be discharged from
<br />his trust and liability upon his bond released.
