<br />Now on this 19th day of December, 1942, this matter came on to be heard upon the pleadings
<br />and the evidence and was submitted to the court, on consideration whereof the court finds that due
<br />and legal notice of this proceedings has been given to all persons interested in said matter, both
<br />creditors and heirs as required by law, That all of the statements and allegations set forth in
<br />said petition are true; that the said Augusta Wiegert died intestate in Merrick County, Nebraska,
<br />on October 24, 1934, seized and possessed at the time of her death of the following described real
<br />estate, to -wit:
<br />An undivided one -sixth interest in the East Half of the Northwest Quarter (EJNWJ) and in the
<br />Southwest Quarter of the Northwest Quarter (SANW4) and in the West Half of the Northeast
<br />Quarter (WJNEJ) and in the Northwest Quarter of the Southwest Quarter (NASWU and in the
<br />Northeast Quarter of the Southeast Quarter (NE4SE4) of section Sixteen (16) Township Twelve
<br />(12); North, Rana Eight (8), West of the 6th P. M., and in the Northeast Quarter of the North-
<br />west Quarter (NEjNW}) of Section Fifteen (15), Township Twelve (12),North,Range Eight (S),West
<br />of the 6th P.M., in Merrick County, Nebraska.
<br />And also an undivided one -fifth interest in Lot Four (4), Block Thirty -three (33), Original
<br />Town, now City of Grand Island,Hall County, Nebraska.
<br />That no application has been made in the State of Nebraska for the appointment of an administrator
<br />of the estate of the deceased. That she left surviving her, her husband, Herman Wiegert, and six
<br />children, they being, Meta Meyer, Erna Niemoth, Marie Ehlers, daughters, and Alfred Wiegert,
<br />George Wiegert and William Wiegert, sons. That they are the sole and only heirs -at -law of said
<br />Augusta Wiegert, deceased, and her interest in the above described real estate passed and descended
<br />to Herman Wiegert, the husband, an undivided one -third thereof, and to each of said children an
<br />undivided one -ninth thereof.
<br />IT IS THEREFORE CONSIDERED AND ADJUDGED BY THE COURT that the interest of Augusta Wiegert,
<br />deceased, in the above described real estate be and the same hereby is assigned to the said Herman
<br />Wiegert, an undivided one -third thereof and to Meta Meyer, Erna Niemoth, Marie Ehlers, Alfred
<br />Wiegert, George Wiegert and William Wiegert, an undivided one -ninth to each. It is further con-
<br />sidered and adjudged by the court that all claims and demands against the estate of deceased,
<br />whether due or to become due, whether absolute or contingent, be and the same hereby are forever
