<br />in said estate have been fully paid and that said Administratrix has distributed all money coming
<br />into her hands according to the persons entitled to receive the same and has filed their receipts
<br />herein as set out in her said final report and accounting.
<br />EIGHTH
<br />The Court further finds after deducting from the assets of said estate, all debts, claims,
<br />costs of administration, other expenditures and the statutory exemptions allowed the heirs -at -law
<br />in said estate, that there is due and payable to the County Treasurer of Hall County, Nebraska,
<br />and to the United States of America, no inheritance tax whatsoever.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of Ella Steele
<br />as Administratrix in said estate be and the same is hereby approved and allowed as such; further
<br />that Jennie Frank, Ella Steele, Alma Haseloh, Olive Farrall, William H.Frazell, Willadene Frazell,
<br />Harold Frazell, William Frazell, Harold Seybold, Clarence Seybold, Fairy Rhoades, and Clara E.
<br />Barger are all and the only heirs -at -law of said deceased, and that the property described in
<br />paragraph Fifth hereof descends according to the laws of descent and distribution of the State of
<br />Nebraska as found in paragraph Sixth of this decree; that said Administratrix has made full and
<br />complete settlement of said estate with proper receipts filed in this Court showing such disburse-
<br />ments and she is therefore hereby granted an order of distribution and her bond released herein
<br />out of and under seal of this Court.

<br />Now on this 30th day of December, 1942, this matter came on to be heard upon the pleadings and
<br />the evidence and was submitted to the Court, on consideration whereof the Court finds that due and
<br />legal notice of this proceedings has been given to all persons interested in said matter both
<br />creditors and heirs as required by law. That all of the statements and allegations set forth in
<br />said. petition are true; that the said Daniel Powell died intestate in Hall County, Nebraska, on
<br />July 11, 1574, at which time he had made application for a patent of the following described real
<br />estate, to -wit: Thw West Half of the Northwest Quarter NOW and the West 75 rods of the North-
<br />east Quarter of the Northwest Quarter MiNWU of Section Four (4) in Township Nine (9),Range
<br />Eleven (11),West of the 6th P.M., Hall County, Nebraska, and containing 119 acres, with other land.
<br />That he died prior to the issuance of a patent dated November 3, 1557, and filed April 11, 155$,
<br />in Book 1, Page 265 of Deed Records of Hall County, Nebraska, and which patent was executed to
<br />"The Heirs of Daniel Powell, Deceased ". That no administration of the estate of Daniel Powell
<br />for the purpose of determination of heirs has been had and no finding of heirship as ever been
<br />made in this estate. That the said Daniel Powell left surviving him at the time of his death
<br />as his only heirs at law, Martha A.Powell, his widow, Clara Powell, Lucy A.Powell, Grace Powell,
<br />Hala Powell and Grant Powell, his children and the Court hereby finds and determines that they were
<br />the sole and only heirs at law of the said Daniel Powell, deceased and that subject to the dower
<br />rights of the said Martha A.Powell, said real estate descended to said children living at the time
<br />of the issuance of said patent in equal shares; that the said Grant Powell was 4 years of age at
<br />the time of the death of Daniel Powell and died prior to the issuance of said patent and therefore
<br />received no interest in said real estate.
<br />It is therefore considered and adjudged by the court that the above described real estate be
<br />and the same hereby is assigned, subject to the dower rights of Martha A.Powell,the widow,to the
<br />said C1ara'Powell,Lucy A.Powell,Grace Powell and Hala Powell,each an undivided one - fourth therein.
<br />It is further considered and adjudged by the Court that all claims and demands against the estate
<br />of the deceased,whether due or to become due,whether absolute or ciontingent,be and the same are
<br />hereby forever barred.
