im f I ftl W4 <br />THEAUGUSTINECO. 20112.2.41 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />IN THE MATTER OF THE ESTATE OF FINAL DECREE. <br />MARY FRAZELL, deceased. <br />STATE OF NEBRASKA ) At a session of the County Court held in and for said County of Hall <br />COUNTY OF HALL }ss. this 23rd day of December, 1942, present; Paul N.Kirk,County Judge. <br />BE IT REMEMBERED that on the 28th day of November, 1942, Ella Steele as Administratrix of the <br />Estate of Mary Frazell, deceased, filed in this estate her final account as such Administratrix and <br />a petition praying that such account be allowed, for a decree of heirship and an order of distribu- <br />tion, final settlement thereon and discharge. <br />For these purposes the 23rd day of December, 1942, at 10 o'clock A.M. in the County Court Room <br />in said County, was assigned as the time and place for hearing said petition, examining and allow- <br />ing said account, and it was ordered that notice of the pendency of said petition be given to all <br />persons interested in said estate by publishing such notice in the Grand Island Independent, a <br />legal newspaper printed in said County, for three weeks prior to said day of hearing,.and it <br />appears by proof on file that said notice was given as ordered by Court and that no objections have <br />been filed or made thereto and the same should be allowed. <br />Upon an examination of the record and the evidence in this matter and being advised in the <br />premises, the Court finds as follows: <br />FIRST. <br />That Mary Frazell departed this life on the 23rd day of April, 1941, in Harvard, Nebraska, in- <br />testate, while temporarily residing there, but that at the time of her death she was in fact a <br />resident of Hall County, Nebraska. <br />SECOND. <br />That on the 22nd day of June, 1942, Ella Steele, his daughter, filed in this Court a petition <br />praying for the appointment of Ella Steele, as Administratrix of the Estate of said deceased; and <br />on the 22nd day of June, 1942, an order of this Court was made therein, assigning the 16th day of <br />July, 1942, at 10 o'clock A.M. at the County Court in said County as the time and place for hearing <br />said petition,-and ordering that notice of the pendency of said petition and the hearing thereof be <br />given to all persons interested in said matter by publication of such notice in the Grand Island <br />Independent, a legal newspaper printed in said County for three successive weeks prior to said <br />day of hearing, and it appears by proof on file that notice of said order was given as ordered by <br />this Court. <br />THIRD. <br />The Court further finds that Ella Steele named in said petition was, upon her giving bond in <br />the sum of $100.00 as ordered by this Court, appointed Administratrix as prayed; the Court further <br />finds that the deceased at the time of her death, was a widow, and that she left the following <br />heirs -at -law; Jennie Frank, a daughter, Ella Steele, a daughter, Alma Haseloh, a daughter, Olive <br />Farrall, a daughter, William H.Frazell, a son, Willadene Frazell, a granddaughter, being the only <br />child of a predeceased son Lewis Frazell, Harold Frazell, a grandson, and William Frazell, a <br />grandson, they being the only children of a predeceased son Leroy Frazell, Harold M.Seybold, a <br />grandson, Clarence Seybold, a grandson, Fairy Rhoades, a granddaughter, and Clara E.Barger, a <br />granddaughter, they being the children of a predeceased daughter Emma Seybold. <br />FOURTH. <br />That on the 20th day of July, 1942, an order of this Court was made allowing creditors three <br />months in which to file their claims in said estate from the 12th day of August, 1942, and further <br />ordering that notice of the same be published for three successive weeks in the Grand Island <br />Independent, a. legal newspaper published and circulating in Grand Island,Hall County, Nebraska, <br />and it appears by proof on file that notice of said order was published as ordered by this court, <br />and said Administratrix was given one year in which to settle said estate. <br />FIFTH. <br />The Court further finds that on the 22nd day of July, 1942, the said Ella Steele, as Administra- <br />trix, filed in this Court her inventory of the property of said estate, and that according to said <br />Inventory the deceased died seized and possessed of the following described property, to -wit: <br />An undivided one -third (1/3) interest in Lot Eight (9) in Block Twenty -two (22) in Nagy's <br />Addition to Grand Island, in Hall County, Nebraska, which was decedents homestead; also <br />An undivided one -third (1/3) interest in Lot Ten (10) in Block Five (5) of Evanel Addition <br />to the City of Grand Island,Hall County, Nebraska. <br />SIXTH. <br />The Court further finds that according to the laws of descent and distribution, said property <br />descends as follows, to -wit: <br />To Jennie Frank, an undivided 1/8 <br />Ella Steele, it 11$ <br />Alma Haseloh, " 118 <br />Olive Farrall " 1/� <br />William H.Frazell " 1/8 <br />Willadene Frazell " 1/8 <br />Harold Frazell " 1/16 <br />William Frazell If 1/16 <br />Harold Seybold If 1/32 <br />Clarence Seybold If 1132 <br />Fairy Rhoades " 1/32 <br />Clara E.Barger If 1/32 <br />SEVENTH. <br />The Court further finds that Pearl D.Willis, County Treasurer, for the County of Hall, Nebraska, <br />filed a claim against said estate on July 9, 1942, in the sum of $728.61; that on November 29, 1942, <br />the County of Hall, Nebraska, by Theodore P.Boehm, Chairman of the Board of Supervisors, and J.H. <br />Jones, County Clerk, filed a partial release of said claim, acknowledging payment of the sum of <br />$150.00 on said claim, whereby said County of Hall released the balance being the sum of $578.61, <br />from any and all lien against the undivided one -third interest in Lot Eight (8) in Block Kenty- <br />two (22 in Nagy's Addition to Grand Island, in Hall County, Nebraska, and against the undivided <br />one -third interest in Lot Ten (10) in Block Five (5) of Evans' Addition to the City of Grand Island, <br />Hall County, Nebraska, thereby clearing said real estate from any and all lien of said unpaid <br />balance due on said claim, which claim had heretofore been duly allowed by the Court in these <br />proceedings: that all other debts and claims against said estate and the costs of administration <br />
