199 <br />of Blanche M.Miller, Katharyn Hoye, and William Suhr, Executors of the last will and testament of <br />Fred J.Miller, deceased, and upon their petition for settlement of the estate and their discharge, <br />The Court, having examined said report and the files in said estate and being duly advised, <br />finds that due and legal notice has been given to all persons interested in said estate of the <br />time and place fixed for hearing upon said final report, as heretofore ordered by the Court, and <br />no one appearing to object thereto, the Court examined the same, together with the vouchers on <br />file and the testimony in support thereof, and being duly advised in the premises, finds that <br />said report is true and correct in all things and should be approved and allowed as and for <br />their final report. <br />The Court finds that said Fred J.Miller departed this life on the 26th day of December, 1939, <br />at the time of his death Was a resident and inhabitant of Hall County, Nebraska; that on the 30th <br />day of December, 1939, a petition was filed herein for the probate of an instrument purporting to <br />be the last will and testament of said Fred J.Miller, deceased, the Court thereupon made an order <br />fixing the 27th day of January, 1940, as the date for making proof of said last will and testament, <br />and due notice of the filing of the petition and of the time and place fixed for hearing thereon <br />was given by the Court in the manner provided by law, and on said date, January 27, 1940, said <br />instrument was duly proven, allowed, and admitted to probate in this Court as and for the last <br />will and testament of said Fred J.Miller, deceased, and letters testamentary were duly issued to <br />Blanche M.Miller, Katharyn Hoye, and William Buhr, executors as named in said last will and <br />testament, and they thereupon duly qualified as such. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for the filing of claims against said estate and that all claims filed <br />against. said estate have been paid in full and the time fixed for filing claims has fully expired. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims <br />against said estate, if any such there be, and not filed herein, are forever barred and excluded <br />from setting up or asserting any such claims against said estate. <br />The Court further finds that said Fred J.Miller died seized of the following described real <br />estate: <br />The northeast quarter of Section Thirty -two (32), Township Eleven (11) North of Range Twelve <br />(12), Hall County, Nebraska. <br />The west half of the northeast quarter of Section Twenty -eight (29), Township Eleven (11) <br />North,Range Twelve (12), in Hall County, Nebraska, <br />The west half of the northwest quarter of Section Twenty -eight (29)0 Township Eleven (11) <br />North,Range Twelve (12), Hall County, Nebraska. <br />The east half of the nor <br />North,Range Twelve (12) <br />The northwest quarter of <br />(11), North,Range Twelve <br />The northwest quarter of <br />Hall County, Nebraska, <br />thwest quarter of Section Twenty -eight (29), in Township Eleven (11) <br />West of 6th P.M., in Hall County, Nebraska. <br />the northwest quarter of section Thirty -three (33), Township Eleven <br />(12),Hall County, Nebraska. <br />Section Seven (7), in Township Ten (10) North,Range Eleven (11) West, <br />The east half of the northeast quarter of section Five (5), Township Ten (10) North,Range <br />Eleven (11),Hall County, Nebraska, <br />The south half of the northwest <br />Range Eleven (11) West, in Hall <br />The north half of the northwest <br />North,Range Twelve (12) West of <br />Lots Eleven (11) and Twelve (12 <br />Nebraska. <br />quarter-of Section Twenty (20), Township Ten (10) North, <br />County, Nebraska. <br />c�uarter of section Twenty -one (21), in Township Eleven (11), <br />6th P.M. Hall County, Nebraska. <br />in Block Eight (8), Town of Wood River, Hall County, <br />The Court further finds that the executors have paid the inheritance tax, both state and <br />Federal. <br />The Court further finds that distribution has been made according to the terms of the last <br />will and testament and as heretofore ordered by the Court in construing the provisions of the last <br />will and testament of said Fred J.Miller, deceased. <br />The Court further finds that the executors have fully performed all of their duties and obliga- <br />tions and nothing further remains for them to do, and there is no more property in their hands for <br />distribution. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of said <br />executors of the last will and testament of Fred J.Miller, deceased, be, and the same is hereby <br />approved and allowed as and for their final report,and said estate is hereby settled and closed <br />and said ,executors are discharged from their bonds and are hereby released. <br />IT I5 FURTHER ORDERED BY THE COURT THAT under the last will and-testament of Fred J.Miller, <br />deceased, the absolute title to the following described real estate passed and descended, under <br />and by virtue of said last will and testament, as follows: <br />To Katharyn Hoye the northeast quarter of Section 32, in Township 11 North,Range 12 West of <br />6th P.
