<br />I. Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on the
<br />14th day of April 1942, the instrument purporting to be the last will and testament of Albert J.
<br />Niemoth,deceased, was filed for probate in this Court. That on the 14th day of May 1942, said
<br />instrument to which this certificate is attached was duly proved, probated and allowed as the last
<br />will and testament of the real and personal estate of said Albert J.Niemoth deceased, and the same
<br />was ordered to be recorded in the records of the Court aforesaid.

<br />NOW on this 23rd day of December 1942, this cause came on for hearing upon the final report
<br />filed herein by Fred Niemoth, executor of the estate of Albert J.Niemoth, deceased, and upon his
<br />application for the approval and allowance of said report, settlement of said estate and his dis-
<br />charge as executor of said estate, and the Court having examined the records and files herein, in-
<br />cluding said report and vouchers thereto attached, and being fully advised in the premises finds
<br />as follows:
<br />That on the 14th day of April, 1942, Fred Niemoth,son of Albert J.Niemoth, deceased, filed his
<br />petition in this Court in which he alleged, among other things, that Albert J.Niemoth departed this
<br />life in Hall County, Nebraska on the 9th day of April, 1942, leaving a Last Will and Testament in
<br />which Fred Niemoth was named executor thereof, which instrument he offered for probate as the Last
<br />Will and Testament of said deceased and asking that an executor thereof be appointed; that upon
<br />reading and filing said petition this Court entered an order fixing the time and place for hearing
<br />said petition and giving notice thereof, as provided by law, and that said matter coming on to be
<br />heard, upon the date fixed by the Court, said instrument was duly admitted to probate in this Court
<br />as the Last Will and Testament of said deceased, and Letters of Administration were issued to the
<br />said Fred Niemoth.
<br />That due and legal notice has been given to all persons of the time and place fixed by the
<br />Court for filing claims against said estate; all claims not filed within the time fixed by the
<br />Court, if any such there be, should be forever barred, excluded and enjoined from slitting up or
<br />asserting any such claims against said estate.
<br />That deceased departed this life, leaving as his heirs at law and only heirs at law, devisees,
<br />legatees, and persons entitled to share in his estate, the following named persons; August Niemoth,
<br />son, Fred Niemoth, son, Minnie Rauert, daughter, Bertha Schuett, daughter, all of Grand Island,
<br />Nebraska, and Ella Schmaltz, daughter, Pearl Niemoth,daughter, both of Detroit, Michigan, Elizabeth
<br />Nelson, daughter, Central City, Nebraska, Laura Knox, daughter, Gerber, California.
<br />That the deceased departed this life the owner, in fee simple title, in and and to the follow-
<br />ing real estate situated in Hall County, Nebraska, to -wit:
<br />North Half of the Northwest Quarter (N *NWJ) and the North Half of the Northeast Quarter
<br />(N2NEJ ) of Section 26, Township 12, North Range 9, West of the 6th P.M., Hall County,
<br />Nebraska.
<br />Southeast Quarter and the Southwest Quarter (SEJ SWJ) of Section 23, Township 12�North,Ra.nge
<br />9 :West of the 6th P.M., Hall County, Nebraska.
<br />Northeast Quarter and the North Half of the Southeast Quarter (NEJ NJSEJ) of Section 27,
<br />Township 12 North,Range 9, West of the 6th P.M., Hall County, Nebraska.•
<br />Lot 9, Block 25,Russel Wheelers Addition to the City of Grand Island,Hall County, Nebraska.
<br />and the said real estate hereinbefore described did pass and descend under the terms of the said
<br />Last Will and Testament as follows:
<br />To August Niemoth, the North Half of the Northwest Quarter (N*NWJ) and the North Half of the
<br />Northeast Quarter (N*NE`) of Section 26, Township 12 North,Range.9,West of the 6th P.M., Hall
<br />County, Nebraska, subject to the life estate of Bertha Niemoth,wife of the said Albert J.
<br />Niemoth.
<br />To Laura Knox, Minnie Rauert, Ella Schmaltz, Bertha Schu
<br />Niemoth, the Southeast Quarter and the Southwest Quarter
<br />12 North,Range 9,West of the 6th P.M., and the Northeast
<br />Southeast Quarter (NEj NQSE4) of Section 27, Township 12
<br />all in Hall County, Nebraska, subject to the life estate
<br />Albert J.Niemoth.

<br />of Bertha Niemoth, wife of the said
<br />To August Niemoth, Fred Niemoth,Laura Knox,Minnie Rauert, Ella Schmaltz, Bertha Schuett,
<br />Elizabeth Nelson and Pearl Niemoth, each an undivided one eighth (11$) interest in and to
<br />Lot 9, Block 25, Russel Wheelers Addition to the City of Grand Island, Hall County,Nebraska.
<br />The Court further finds that the said Bertha Niemoth, a former wife of the deceased herein,
<br />predeceased the said Albert J.Niemoth, testator and that the said Bertha Niemoth died a resident
<br />and inhabitant of Hall County, Nebraska on the tth day of July,1940 and that her estate was offered
<br />for probate in the County Court of Hall County, Nebraska and decree entered and filed therein on
<br />the - - - -- day of April, 1941, and said life estate given her under the terms of the Last Will and
<br />Testament of the said Albert J.Niemoth,deceased, has fully elapsed and determined.
<br />That all of the claims filed in said estate have been paid and satisfied.
<br />That the final report filed herein is true and correct, in all things,'and that the same should
<br />be approved and allowed as his final report in said estate, -said estate settled and closed, said
<br />executor and his official bondsman discharged and released from any further liability in said
<br />matter.
