<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA
<br />IN THE MATTER OF THE ESTATE OF : DECREE OF HEIRSHIP
<br />CHRISTIAN W.HARFST, DECEASED :
<br />Now on this 16th day of December, 1942, this cause came on for hearing before the Court on the
<br />petition of Elsie C.Harfst and the court finds that due and legal notice of the time, place and
<br />purpose of this hearing has been given to all persons interested in said estate, both creditors
<br />and heirs at law, in the manner provided by law-1
<br />The Court finds that Christian W.Harfst departed this life on the 14th day of July, 1934, in-
<br />testate, and a resident of Hall County, Nebraska. That at the time of his death he was seized
<br />and possessed of
<br />A Northeast Quarter (NEJ) of Section Thirteen (S13), Township Eleven North (TllN), Range
<br />Eleven West (RllW) of the Sixth Principal Meridian, Hall County, Nebraska.
<br />That the petitioner is a widow of said deceased and by reason thereof the owner of an undivided
<br />interest in said premises.
<br />The Court finds that no administration has been had upon the estate of said deceased in the
<br />State -of Nebraska and no application or proceedings for administration have been commenced or are
<br />now pending in this State.
<br />The Court further finds that the said Christian W. Harfst left surviving him, as his sole and
<br />only heirs at law, and the only persons entitled to participate in his estate, Elsie C.Harfst,
<br />widow, Theodore C.Harfst, ifalter W,Harfst, tha Harfst Eberl, Louise Harfst, and Christine
<br />Harfst Soder. That all said heirs are of full legal. age.
<br />The Court finds that the funeral expenses of said deceased have been paid and that the Court
<br />costs and expenses of administration have been paid and that there are now exg,isting no debts
<br />against the estate of said deceased. That more than two years have elapsed since the death of the
<br />said deceased and no claims are now provable. That there is no personal property to be administered
<br />and that neither said estate nor the heir at law are subject to estate or inheritance taxes, and
<br />that no necessity exists for administration.
<br />IT IS, THEREFORE, CONSIDERED, ADJUDGED AND DECREED by the Court that the said Christian W.
<br />Harfst died as above set forth; that he left surviving him as his sole and only hairs at law and
<br />the only persons entitidd to participate in his estate, the persons whose names and kinship is as
<br />above found; that the lands and premises above described do pass and descend to the heirs above
<br />named, in accordance with the Intestate Laws of Nebraska in force at the time of the death of the
<br />deceased.
<br />That no necessity exists for administration, and that administration be dispensed with. That
<br />neither said estate nor the heirs at law is subject to estate or inheritance taxes, that no claims
<br />are now provable, and that any and all claims against said estate be and are forever barred.

<br />That said Presley G.Athey died testate November 26th, 1941, and that his Last Will and Testament
<br />has been duly and regularly admitted to probate herein.
<br />That by the terms of the Last Will and Testament of the said deceased, all of the estate of
<br />said dpcpased was disposed of as follows:
<br />To LENORA PIERSON, daughter of said deceased, one- fourth thereof.
<br />To DELLA WARD ATHEY, wife of said deceased, three- fourths thereof.
<br />That the estate of said deceased to be distributed in the foregoing proportions to the foregoing
<br />persons, consists of the following personal property, to -wit:
<br />A first Mortgage of 44,000.00, dated September 30th, 1922, executed by Albert Ward and Della
<br />Ward, husband and wife, covering that certain real property located in the County of Hall, State
<br />of Nebraska, more particularly described as the North -west quarter of Section 12, Township 9
<br />North,Range 10 West, Sixth P.M., said mortgage being recorded October 6th, 1922 in Book 56,
<br />page 165 of records of said County, and refiled and re- recorded November 23rd, 1936 in Book
<br />75, page 70 of Mortgages, records of Hall County, Nebraska.
<br />Said mortgage secures a note for $4,000000 dated September 30th, 1922, payable on the lst day
<br />of October, 1927, drawing interest from October lst, 1922, at the rate of 52% per annum, payable
<br />semi- annually, executed by Albert Ward and Della Ward, in favor of Thomas Frahm, said note and
<br />mortgage having been duly extended from t1m6 to time, and having on the 24th day of October 1936
<br />been assigned by the said Thomas Frahm to Presley G.Athey by assignment of mortgage recorded
<br />November 23rd, 1936 in Book 28, page 566 of Releases and Assignments, records of Hall County,
<br />Nebraska.
<br />That all other property belonging to said estate not herein described and not now known or
