Ryan and Henry Mehlert, Junior, of Spokane, Washington and that said pecuniary <br />legacies have been fully paid; that the deceased left as her sole residuary devisees and legatees <br />Mrs. Gesina Bade, her sister -in -law, of Cheyenne, Wyoming, Mrs. Sophia Brandt, her sister of Bismark, <br />North Dakota, the children and grandchildren of her deceased sister Amanda Windolph - namely Albert <br />Windolph, Elsa Lassen, Hugo Windolph, Walter Windolph, Otto Windolph, and Clara Schultz, children <br />of Amanda Windolph, deceased, and Harold Windolph and Phyllis Windolph children of. William Windolph, <br />deceased, who was a son of Amanda Windolph, deceased, and predeceased the testatrix; that the de- <br />ceased died seized in fee simple o the legal and equitable title to the real estate hereinbefore <br />respectively described located in Nebraska and Colorado and died owning the equitable title to <br />certain fractional interests in real estate mortgages as herein before found and described; that <br />the legal title to the interests in the real estate equitably and beneficially owned by the de- <br />ceased is held by the Grand Island Trust Company of Grand Island, Nebraska, as trustee; that said <br />legal and equitable interests in the real estate and the equitable interests in the mortgages as <br />hereinbefore set forth passed and descended as residuary estate of the testatrix under the terms of <br />the will and the statute of Wills of Nebraska and Colorado, respectively according to the respective <br />locations thereof to the residuary devisees and legatees above named, in the following proportions, <br />to Gesina Bade an undivided one third ?part, to Sophia Brandt an undivided one third part thereof, <br />and to Albert Windolph, Elsa Lassen, Hugo Windolph, Walter Windolph, Otto Windolph and to Clara <br />Schultz each an undivided one twenty -first part thereof and to Phyllis Windolph and Harold Windolph <br />each an undivided one- forty - second part thereof and the same is.so awarded to them pursuant to the <br />will, the statute of wills and the written request of the residuary devisees and legatees filed <br />herein; that the estate has been fully administered and the executor is hereby discharged, his <br />bond released and the estate closed. <br />Paul N.
