<br />them; that said estate is not subject to a Federal estate tax and that the inheritance taxes under
<br />the laws of Nebraska on the succession to said estate have been duly assessed and determined and
<br />have been fully paid by the executor of the estate; that the cash residue of the estate has been
<br />distributed in accordance with the will and the order of the court to the residuary legatees under
<br />the will; that the deceased left as her sole pecuniary legatees the two children of her deceased
<br />husband, Mrs. M.F. Ryan and Henry Mehlert, Junior, of Spokane, Washington and that said pecuniary
<br />legacies have been fully paid; that the deceased left as her sole residuary devisees and legatees
<br />Mrs. Gesina Bade, her sister -in -law, of Cheyenne, Wyoming, Mrs. Sophia Brandt, her sister of Bismark,
<br />North Dakota, the children and grandchildren of her deceased sister Amanda Windolph - namely Albert
<br />Windolph, Elsa Lassen, Hugo Windolph, Walter Windolph, Otto Windolph, and Clara Schultz, children
<br />of Amanda Windolph, deceased, and Harold Windolph and Phyllis Windolph children of. William Windolph,
<br />deceased, who was a son of Amanda Windolph, deceased, and predeceased the testatrix; that the de-
<br />ceased died seized in fee simple o the legal and equitable title to the real estate hereinbefore
<br />respectively described located in Nebraska and Colorado and died owning the equitable title to
<br />certain fractional interests in real estate mortgages as herein before found and described; that
<br />the legal title to the interests in the real estate equitably and beneficially owned by the de-
<br />ceased is held by the Grand Island Trust Company of Grand Island, Nebraska, as trustee; that said
<br />legal and equitable interests in the real estate and the equitable interests in the mortgages as
<br />hereinbefore set forth passed and descended as residuary estate of the testatrix under the terms of
<br />the will and the statute of Wills of Nebraska and Colorado, respectively according to the respective
<br />locations thereof to the residuary devisees and legatees above named, in the following proportions,
<br />to Gesina Bade an undivided one third ?part, to Sophia Brandt an undivided one third part thereof,
<br />and to Albert Windolph, Elsa Lassen, Hugo Windolph, Walter Windolph, Otto Windolph and to Clara
<br />Schultz each an undivided one twenty -first part thereof and to Phyllis Windolph and Harold Windolph
<br />each an undivided one- forty - second part thereof and the same is.so awarded to them pursuant to the
<br />will, the statute of wills and the written request of the residuary devisees and legatees filed
<br />herein; that the estate has been fully administered and the executor is hereby discharged, his
<br />bond released and the estate closed.

<br />Now, on this 12th day of November, 1942, this matter came on for hearing before the Court on the
<br />petition of Mamie Keefe, and the Court finds that due and legal notice of the time, place, and
<br />purpose of this hearing has been given to all persons interested in said estate, both creditors and
<br />heirs at lath in the manner provided by law.
<br />THE COURT FINDS that James Keefe departed this life on the 4th day of December, 1915, intestate,
<br />and a resident of Hall County, Nebraska; that at the time of his death was seized and bossessed of
<br />the title in fee to the following described property:
<br />An undivided one half interest in the South Half (S)40 of the northwest Quarter (NW4) of
<br />Section Twenty -six (26) in Township Ten (10),North Range Twelve (12) West; the other one -
<br />half interest being owned by Mary Ann Keefe;
<br />Also the North Half (N0 of the Southwest Quarter (SW4) of Section Twenty -six (26) in Township

<br />Northeast corner thereof, which is owned and used for school purposes.);
<br />Also the Southwest Quarter (SW4) and the East Half (EQ) of the Southeast Quarter (SE4) of
<br />Section Thirty -four (34), Township Ten (10),North,Range 12 West, also, Lot Five (5) in Block
<br />"D ", First Addition to the Village of Woodriver, Hall County, Nebraska, as shown by recorded
<br />plat thereof; all being located in Hall County, Nebraska.
<br />That the petitioner is a niece of said deceased, and by reason thereof, the owner of an un-
<br />divided interest in a portion of the above described property by reason of inheritance from
<br />Richard Keefe, brother of the above named deceased and father of this petitioner.
<br />THE COURT FINDS that no sufficient administration has been had upon the estate of said de-
<br />ceased in the State of Nebraska, no applications or proceedings for administration as provided
<br />by law have been commenced or are now pending in this state.
<br />THE COURT FURTHER FINDS that the said James Keefe left surviving as his sole and only heirs at
