<br />HALL COUNTY )ss' that I have compared the foregoing copy of Last Will and Testament, Cer
<br />tificate of Probate of Will and Final Decree - IN THE MATTER OF THE ESTATE OF ALFRED ELWICK,DE-
<br />CEASED, with the original record thereof, now remaining in said Court, that the same is a correct
<br />transcript thereof, and.of the whole of such original record; that said Court is a Court of Record
<br />having a seal, which seal is hereto attached; that said Court has no Clerk authorized to sign
<br />certificates in his own name, and that I am the legal custodian of said Seal and of the Records of
<br />said Court and that the foregoing attestation is in due form of law.

<br />WILL AND DECREE
<br />I,Villa A.Marks,Widow,of Grand Island,Nebraska,being of sound mind and disposing memory do make
<br />and publish this ,my last will and testament,in the manner and form follvwing,that is to say:
<br />I direct that my just debts,if any,and the U#Rges attending my burial,be first paid.
<br />SECOND.
<br />I give,deiise,and bequeath to my beloved son,Bert A.Marks,who is a cripple,all of the property
<br />of which shall die the owner, and whether now held by me or hereafter acquired.
<br />THIRD.
<br />In the event my said don,Bert a Marks,should die before the time of my death,then and in that
<br />event I give,devise,and bequeath all of my property,both real and personal,owned by'me at the
<br />time of my death, to my children,Mary Alice McKibben,Luretta McDowell, John V.Marks,and Edward S.
<br />M arks,and to the survivors of them living at the time of my death,share and share .bltke.I make
<br />no provision in this will for my grandchildren,nor for my son,Jisner Marks,whom I believe to be
<br />dead,as he has been absent and unheard from for fifteen years.If living,his want of consideration
<br />in not advising me of his whereabouts does not entitle him to any of my bounty.
<br />FOURTH.
<br />I nominate and appoint my son,Edward S.Marks,as Executor of this will.hereby granting to said
<br />Execeutor full power and authority to sell and convey real estate without license or authority
<br />from any Court.
<br />FIFTH.
<br />I hereby revoke any and all former wills made by me.
