<br />I' Arthur J.Mills do make this Codicil to my last Will herewith dated the'l6th day of December,
<br />1921 ' hereby ratifying and confirming my�last Will, except so far as this Codicil changes the same.
<br />Having executed and delivered to Cotner College and Estate note for Ten Thousand ($10,000.00)
<br />Dollars, dated April 22nd,1925, bearing 4% per annum interest and to be paid out of my estate 60
<br />days after my decease and signed jointly by me and Clara A.Mills, my wife, I now order and direct
<br />that said note shall be deducted from any and all bequests made by me to Cotner College in Section
<br />Fourth of my said last Will.

<br />I, W.Halsey Bohlke, County Judge, in and for said County, do hereby certify that on this 24th
<br />day of March, A.D. 1934, the instrument purporting to be the last will and testament of the said
<br />Arthur J.Mills, deceased, which was filed in this Court, on the 5th day of March, A.D. 1934, and
<br />being the instrument to which this is annexed; was duly proved, approved, probated and allowed, as
<br />the last will and testament of the said Arthur J.Mills, deceased, in and for the State of Nebraska;
<br />and it was ordered. to be recorded in the records of the County Court aforesaid.

<br />That on said 24th day of March, 1934, this court made and entered an order appointing Clara
<br />A.Mills as the executrix of said will and estate, and on that date she qualified as such and has
<br />been acting in that capacity since; that on the 7th day of April, 1934, this court made and entered
<br />an order that notice to creditors be given to file claims, if any, against said estate, on or before
<br />August 9th, 1934; that said notice was published as required by law; that thereafter certain claims
<br />were filed and allowed, and an order was made and entered after the 9th day of August, 1934, barring
<br />all claims not filed.
<br />That said deceased died seized and in possession of the following described real estate, to -wit:
<br />An undivided 112 interest in and to the Southwest Quarter of Section 15, township 7, north,
<br />range 10, West 6th P.M., in Adams County, Nebraska.
<br />An undivided 1/6 interest in Lots 13 to 15 inclusive, in block 15, Johnson's Addition to
<br />Hastings, Nebraska.
<br />An undivided 112 interest in and to the Southwest Quarter of Section 5, township 13,north,
<br />range 31, West 6th P. M., in Lincoln County, Nebraska.,
<br />Also, an undivided 1/2 interest in Lot 3, in Block 2, Giddeon's Addition to Doniphan, Hall
<br />County, Nebraska.
<br />That on the 14th day of December, 1937, said Clara A.hjills, executrix, filed in this court a
<br />report of the amounts by her received and disbursed since her appointment as executrix, which
<br />report reflects the payment of all claims allowed against said estate, all of the costs of admin
<br />istration, including the expense of the last sickness and,burial of said deceased, and there remains
<br />in her possession cash in the sum of $ The court finds that said report is in all things
<br />correct and should be approved as the final report of said executrix.
<br />Testimony is heard relative to the value of the estate as to inheritance tax purposes, and the
<br />.court finds that the value of the estate is less than is exempt to the devisees under the will of
<br />said deceased, the principal devisees Clara A.Mills and Wenona Mills Gerhard being related to the
<br />deceased as widow and daughter, and the brothers and sisters, devisees as mentioned in Paragraph
<br />Third of said will, and also the devisees as mentioned in Paragraph Second of said will, all
<br />being related to the deceased, for that reason the value of the property to each devised is less
<br />than is exempt to them by the laws of the State of Nebraska.
<br />The court finds that there is no further reason for the c- )ntinuance of said estate, and the
<br />same should be closed.
<br />That certain bonds, stocks, notes and judgments as described in the inventory herein have not
<br />been reduced to cash on account of there being no sale for same, and the residuary legatees herein
<br />desire that the same be assigned to them absolutely.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT:
<br />1. That the report of said Clara A.Mills as executrix be and the same is hereby in all things
<br />approved as her final account; that the balance as shown in her possession be and the same is hereby
<br />ordered paid to said Clara A.Mills in consideration of her fees, commissions and expense as such
<br />executrix, and when receipt therefor is filed in this court, that she be discharged as such execu-
<br />trix, and her letters testamentary cancelled and annulled.
<br />2. It is further ordered tna.t the undivided 112 interest of the deceased in and to the
<br />Southwest Quarter of Section 15, township 7, north, range 10, West 6th P.M , in Adams County,
<br />Nebraska, and the undivided 112 interest of the deceased in and to the Southwest Quarter of
