<br />City of Hastings, County of Adams, and State of Nebraska.

<br />ARTHUR J.MILLS, Deceased. )
<br />Now on this 31st day of December, 1937, this matter comes on for hearing on the petition of
<br />Clara A.Mills, executrix of the will and estate of Arthur J.Mills, deceased, praying for the
<br />allowance of her final report filed, and for her discharge from said trust.
<br />The court finds that due notice has been given by publication of the time and place of this
<br />hearing, as required oy law and the former order of the court, and that this court has jurisdic-
<br />tion over all interested parties, and the subject matter of said estate.
<br />The executrix Clara A.Mills, and. her attorney L.B.Stiner of Hastings, Nebraska; also Wenona
<br />Mills Gerhard, described in the will of said deceased hereinafter referred to,' and in the pro-
<br />ceedings had herein, as Wenona n.Mills, present in court; also Edmund Nuss, County Attorney of
<br />Adams County, Nebraska.
<br />No objections having been filed to the report of said executrix or to the prayer of her
<br />petition for final settlement, the court, in consideration of the records and files herein, and
<br />of the evidence finds:
<br />That Arthur J.Mills departed this life a resident of Adams County, Nebraska, on the 1st day of
<br />March, 1934; that he left surviving him as his sole heirs at law, next of kin and the only persons
<br />interested in his estate, the following persons:
<br />Clara A.Mills, widow
<br />Wenona Mills Gerhard, daughter
<br />Jennie M.Livengood, sister
<br />Clara Harris, sister
<br />Leonard P. Mills, brother
<br />Lucy Marion, sister
<br />Bert B.Mills, brother
<br />That said deceased left no other child or children, nor the child or children of any deceased
<br />child, nor father or mother, him surviving, and that the above are all of the persons interested
<br />in his estate.
<br />That on the 5th day of March, 1934, Clara A.Mills and Wenona HMills, filed in this court
<br />their petition praying for the probate of an instrument which they alleged to be the last will and
<br />testament of said deceased; that on that date this court made and entered an order setting the
<br />24th day of March, 1934, at the county court room in Hastings, Nebraska, as the time and place
<br />for hearing said petition; that on the 24th day of March, 1934, after due notice had been given
<br />by publication, as provided by law, and the order of the court, evidence was heard, and this
<br />court made and entered an order allowing and probating the said instrument as the last will and
<br />testament and codicil thereto, of said deceased, which will and codicil, with the certificate of
<br />its probate, is in words and figures as follows:
<br />LAST WILL AND TESTAMENT OF ARTHUR J.MILLS
<br />I, Arthur J.Mills) of Hastings, Adams County, Nebraska, being of sound mind and memory, do
<br />hereby make, publish and declare this my last will and testament, in the manner and form following,
<br />that is to say:
<br />FIRST. I will and declare that all of my just debts, expense of last sickness and funeral
<br />expenses be paid by my executor, hereinafter named, out of my personal property.
<br />SECOND. I hereby give, devise and bequeath to Herbert L.Orcut and Fred J.Orcut, all my
<br />interest in Lot Three (3) Block Two (2) Giddeon's Addition to the Village of Doniphan, 'vebraska,
<br />in fee, share and share alike.
<br />THIRD. I hereby ive, devise and bequeath all of my interest in Lots Thirteen (13) Fourteen
<br />(14) and Fifteen (15T Bock Fifteen (15) Johnson's Addition to the City of Hastings, Nebraska, to
<br />my brothers and sisters in fee, share and share alike.
<br />FOURTH. I hereby give, devise and bequeath to my wife, Clara A.Mills, and to my daughter,
<br />Wenona H. Mills, all the residue of my property, both personal and real, of every kind, name,
<br />nature and description, share and share alike, providing they be living at the date of my death,
<br />then I give, devise and bequeath her share to Cotner University, located at Bethany,Nebraska.,
<br />and if my wife Clara A.Mills, should die before my decease, then I give, devise and bequeath
<br />her share to the said Cotner University in fee. In case of an accident in which myself, my wife
<br />and my daughter should be killed, or should all die at and and the same time, then and in that
<br />case I will., devise and bequeath to Cotner University of Bethany, Nebraska, all of the residue
<br />of my property of every kind, name, nature and description in fee.
<br />FIFTH. i hereby make, constitute and appoint my wife, Clara A.Mills, executrix of this my
<br />last will and testament, and desire that she be allowed to act as such executrix without bond.
