<br />County,Nebraska passed and .1scended at the death of the said,Phillip Stoeger,in absolute fee
<br />simple !title to his heirs,hereinbefore named and in the proportion as hereinbefore stated.

<br />NOW on the 28th day of September,1942,this cause came on for hearing upon the petition of Orville
<br />H.Lilley of Loup City,Nebraska,praying for a settlement of the estate of said deceased,for a de-
<br />termination of her heirship,and the right of descent of her real estate,and the degree of kinship
<br />of her heirs -at- law,and a decree settling her estate,And it appearing to the court from the pr000f
<br />on file and From the evidence submitted that due and legal notice has been given by publication
<br />for three successive weeks,as by law and the order of this court provided,to all creditore,heirs-
<br />at- law,and other persons interested in said ectate,of the filing of said petition and of the time
<br />and place Fixed for the hearing on the same,and there being no objections thereto,this cause was
<br />duly submitted to the court upon the petition and the evidence In support thereof,and the court
<br />being fully advised in the premises finds that the allegations of said petition are true,and that
<br />said petitioner,Orville H.Lilley,is the owner of an undivided interest in said real estate here-
<br />inafter described,and is a competent and proper person to prosecute this proceeding.
<br />The court further finds that the said Ora.D.Lilley departed this life intestate at Loup City,
<br />Sherman County,Nebraska,on the 29th day of March,1932,and at the time of her death she was a res-
<br />ident and inhabitant of Sherman County,Nebraska,that she died seized as the owner of Lots Ten (10),
<br />Eleven (11),and Twelve (12),in Block "A ",in the First Addition to the town of food River,Hall
<br />County,Nebraska;that more than two years have elapsed since her death and that no application has
<br />ever been lade in the State of Nebraska for the appointment of an administratok of her estate,and
<br />no petition filed for that purpose,and that no administration has ever been had on the estate of
<br />the said Ora D.Lilley.
<br />IT IS FURTHER ORDERED,ADJUDGED,AND DECEREED BY THE COURT th t il, elebts of said deceased and of
<br />her estate,if any such there Were,are forever barred and precluded,and that further administration
<br />The court further finds -that the said Ora D.Lilley left surviving her as her heirs at law,and
<br />only heirs at law,the following named persons,to- wit:Orville H.Lilley,surviving husband,petition-
<br />er herein,and Robert D.Lilley,a son,that the said Robert D.Lilley is of legal age,and both reside
<br />in Loup City,Nebraska.
<br />The court further finds that under the laws of the State of Nebraska in force at the time of the
<br />death of the said Ora D.Lilley,the said real estate hereinbefore described passed and descended
<br />by absolute title share and share alike to the said Orville H.Lilley and Robert D.Lilley,eurviv-
<br />ing husbanl and son of the said Ora D.Lilley,subject however to the homestead rights of Orville
<br />H.Lilley in and to said premises.
<br />The court further finds that the funeral expenses of said deceased have been fully paid and that
<br />all debts of said deceased and of her estate,if any such existed,are forever barred and precluded,
<br />and that the costs of these proceedings have been fully paid.
<br />IT I8 THEREFORE ORDERED,ADJUDGED,AND DECREED BY THE COURT that the said Ora D.Lilley died intes-
<br />tate in Sherman County,Nebraska,on the 29th day of March,l932,that more than two years have elap-
<br />sed since the death of the said Ora D.Lilley and the filing of this petition;that no application
<br />for the appointment of administrator of her estate has been made nor has there ever been any ad-
<br />ministration on her estate in the State of Nebraska;that said deceased died seized as the owner
<br />of the real estate hereinbefore described situated in .:Hsi ].....s. County,Nebraska; that your petitioner
<br />herein is a competent and qualified person to prosecute this proceeding,that said deceased left
<br />surviving her as her her heirs at Zaw,and her only heirs at Iaw,Orville H.Lilley,her husband,and
<br />Robert D.Lilley,her son,that upon the death of the said Ora D.Lilley the real estate hereinbefore
<br />described passed and descended by absolute title under the intestate laws of the State of Nebraska
<br />in force at the death of the Ora D.Lilley to Orville H.Lilley and Robert D.Lilley in equal shares
<br />to each,subject to the homestead rights of the said Orville H.Lilley in aid to said premises.
