162 <br />THE AUGUSTINE CO. 20112.2.41 <br />WILL AND DECREE <br />LAST WILL AND TESTAMENT OF EMMA KNUTH. <br />I, Emma Knuth, of Grand Island, Hall County, Nebraska, being of sound mind and disposing memory, <br />do make and publish this, my last will and testament, and by it revoking all former wills by me <br />made. <br />FIRST. <br />I direct that my executor, hereinafter named, pay all my just debts, including the expenses of <br />my last sickness and b,..zrial, and the costs and expenses of administering my estate. <br />SECOND. <br />I give, devise, and bequeath all my property, both real and personal, and whether now held by <br />me or hereafter acquired, to my beloved husband, Juergen Knuth, to have and to hold the same abso- <br />lutely. <br />THIRD. <br />I name, nominate, and appoint my husband, Juergen Knuth, as executor of this, my last will and <br />testament, and direct that he be not required to furnish bond as sued, and in the event he is inca- <br />pacitated or does not survive me, then I name, nominate, and appoint William Suhr as executor of <br />this, my last will and testament. <br />IN TESTIMONY WHEREOF, I have hereunto set my hand this 4th day of February, A.D. 1939• <br />Witnesses: <br />Wm. That on the 12th day of July,1939, said <br />instrument to which this certificate is attached was duly proved, probated and allowed as the <br />last will and testament of the real and personal estate•1.of said Emma Knuth deceased, and the same <br />was ordered to be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court this <br />12th day of July, 1939• <br />Paul N.Kirk <br />(SEAL) County Judge <br />HALL COUNTY,NEBRASKA, FILED JUL 12 1939 PAUL N.KI11K COUNTY JUDGE. <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA <br />In the matter of the estate ) #2951 <br />of ) FINAL DECREE. <br />Emma Knuth, Deceased. ) <br />Now, on this 19th day of August, 1942, this cause came on for hearing ui)on the final report of <br />Juergen Knuth, Executor of the last will and testament of Emma Knuth,deeeased, and upon his petition <br />for settlement of said estate and discharge. <br />The Court, having examined the report and the files in said estate and being duly advised in <br />CD <br />the premises, finds that due and legal notice has been given to all persons interested in said <br />estate of the time and place fixed for hearing upon said final report, as heretofore ordered, and <br />no one annearing to object thereto, and the Court being fully advised in the premises, finds that <br />said report is true and correct and should be allowed and approved as and for the said executor's <br />final report. <br />The Court further finds that said Emma Knuth departed this life on the 5th day of May, 1939, <br />and. at the time of her death was a resident and inhabitant of Hall County,Nebraska, and that on <br />the 14th day of June, 1939, Juergen Knuth filed a. petition, praying for the allowance and probate <br />of an instrument purporting to be tree last will and testament of said Emma Knuth, deceased, and the <br />Court thereupon fixed tt-ie 12th day of July, 1939, as the date for hearing thereon, and due notice <br />of the film;; of said. petition and the time and place. fixed for hearing was given by the Court <br />as by law provided, and .on said, date of July 12, 1939, said instrument was duly proven, allowed, <br />and admitted to probate in this court as and for the last will and testament of the said Emma <br />knuth,deceased, and letters testamentary were duly issued thereon to Juergen Knutri, executor, as <br />named in said last will and testament,. and he qualified as such. <br />The Court further finds that due and. legal notice has been given to all persons of the time <br />and place fixed for filinF� claims, ,7n _ thi: t no claims -were filed. <br />The Court further finds that the undertaker's bill of Livings ton- Sonde rmann Funeral Home in <br />he amount of � T,ras paid by said Juergen Knuth personally, as evidenced by the receipt <br />D�FiP",rein; that the attorneys4, fees have been paid, as evidenced by the receipt of the attorneys <br />attached to the final report, and. that the costs of administration have been paid. <br />The Court further finds that the time for filing claims has expired. <br />1 <br />1 <br />1 <br />
