<br />In the Matter of the Estate )
<br />DECREE
<br />of Ella McCullow,Deceased. )
<br />NOW on this 15th day of November,1939,this cause came on to be heard upon the final report of
<br />Mary Whyte,Administratrix of the estate of Ella McCullow,deceased,together with her petition for
<br />the approval and allowance of the said report,settlement of the said estate and discharge of
<br />such administratrix,and the court having examined the records and files herein,having heard the
<br />evidence pertaining-to the said final report and being fully advised in the premises,finds that
<br />the said teport is true and correct and should be approved and allowed as the final report of
<br />the administratrix,said estate settled and closed and the said administratrix discharged and her
<br />sureties on her bond released from all further liability in the said matter.
<br />The court further finds that due and legal notice has been given to creditors of the said estate
<br />and a time and place for filing their claims and hearing thereon,and that all persons having
<br />claims against the said estate,not filed within the time provided by the court,if any such there
<br />be,should be forever barred.
<br />The court further finds that the said decedent departed this life intestate,a resideht and inhab-
<br />itant of said Hall County,Nebraska on the 9th day of April 193g,the owner in fee simple title
<br />of the following real estate,to -wit;
<br />Lot Six (6),Block One Hundred Ten (110),Railroad Addition to the City of Grand Island,Nebraska,
<br />and perpetual use to the Fstate,Half of Lot 64,Row G,Grand Island Cemetery,Grand Island,Hall
<br />C ounty,Nebraska.
<br />The Court further finds that the said decedent departed this life leaving as her heirs,surviving,
<br />and her only heirs,Mary Whyte,d.aughter,in Grand Island,Nebraska,and that the above described real
<br />estate did pass to her at the death of the decedent.
<br />The court further finds that the said real estate is not subject to the payment or charge of any
<br />inheritance tax by virtue or any law in the State of Nebraska or the United States Government.
<br />IT IS,THEREFORE,ORDERED,ADJUDGED AND DECREED by the court that all persons having claims against
<br />the said estate,not filed within the time provided by the court,if any there be,are hereby barred
<br />and excluded from asserting any such claims against the said estate.
<br />IT IS,FURTHER,ORDERED,ADJUDGED AND DECREED by the court that the final report filed herein,by
<br />Mary Whyte,administratrix,be,and the same hereby is approved and allowed,in all things,said
<br />administratrix discharged and Surities released on her bond as such administratrix.
<br />IT IS,FURTHER,ORDERED,ADJUDGED AND DECREED by the court that the real estate hereinbefore describ-
<br />ed owned by the said decedent at the time of her death,did pass and descend,under and by virtue
<br />of the laws of descent of the State of Nebraska,to the heir of the said decedent as hereinbefore
<br />allowed by the court and a distribution and passing of the real estate is hereby so made.
