<br />In the Matter of the Estate

<br />JAMES WILLIAMS, Deceased.
<br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA.
<br />D E C R E E
<br />NO) on this ist day of June, 1942, this cause came on for hearing upon the petition of Edith
<br />Smith, praying for a settlement of the estate of the said James Williams, deceased, for a deter-
<br />mination of his heirship and the right of descent of his real estate, and the degree of kinship of
<br />his heirs at law, and a decree settling his estate, and it appearing to the court from the proof on
<br />file herein that due and legal notice was given by publication for three successive weeks, as by
<br />law and by order of this court provided, to all creditors, heirs -at -law and other persons interested
<br />in said estate, of the filing of said petition and of the date and place fixed for the hearing on
<br />the same, and there being no objections thereto, this cause was duly submitted to the court upon
<br />the petition and the evidence in sup)ort thereof, and the court being fully advised in the premises
<br />finds that the allegations of said petition are true, and that the said petitioner, Edith Smith,
<br />has purchased a part of the real estate hereinafter described and is now the owner thereof, and
<br />that she is a competent and proper person to prosecute this proceeding; that the said James Williams
<br />departed this life on the 3rd day of April, 1908, and at the time of his death he was a resident and
<br />inhabitant of Hall County, Nebraska, that he died seized and the owner of tree following described
<br />premises, to -wit:
<br />Lots Four, Five and Six in Block Seventeen in the Original Town of Wood River, Nebraska,
<br />and all that part of the Northwest Quarter of the Southeast Quarter of Section Nineteen,
<br />in Township Ten, North of Range Eleven, West of the 6th Principal Meridian in Nebraska,
<br />described as follows: Beginning at the Southwest corner of Lot Number Three in Block One
<br />in the Wood River Trooting Association's Addition to the Village of Wood River, Nebraska;
<br />thence east 238 feet; thence North to a line lying 67 feet south of and parallel with the
<br />Union Pacific Railway Company's right of way; thence westerly along said line to the west
<br />boundary line of said addition; thence south to the place of beginning,
<br />and
<br />The South Half o'f the Southwest Quarter and Lots Three and Four, all in Section 9, Township
<br />North Range Eleven,West of the 6th P.M., all of the above described property being in
<br />all County, Nebraska.
<br />that more than two years have elapsed since his death; that no application has ever been made in
<br />the State of Nebraska for the a-opointment of an - administrator of his 'estate, and no petition has
<br />been filed for tl-at purpose, and that no administration has ever been had upon the estate of the
<br />said James Williams, deceased.
<br />The court further finds that the said James Williams left surviving him as his heirs at law
<br />and only heirs at law the following named persons, to -wit:
<br />Elizabeth Williams, his widow,
<br />Ira C.Williams, Charles I.Williams, and Lafe Williams, his sons, 'and
<br />Minnie W.'Chapman, Kate English, Edith Smith and Hattie Byers, his daughters.
<br />The court f,.arther finds that the funeral expenses of said deceased have been fully paid and
<br />that all debts of said deceased and of his estate, if any such existed, are forever barred and
<br />precluded and that the cost of this proceeding has been paid.
<br />IT IS THE:R7FORE ORDERED, ADJUDGED AND DECREED BY THE COURT that the said James Williams died
<br />intestate in Hall County, Nebraska, on the 3rd day of April, 1908; that more than two years have
<br />elapsed between the death of the said James Williams and the filing of this petition; that no
<br />application for the appointment of an administrator of his estate has been filed nor has there
<br />ever been any a'dministra'tion upon his estate in the State of Nebraska; t'lltt said deceased died
<br />seized and the owner of the real estate hereinbefore described situated in Hall County,Nebraska;
<br />that the petitioner, Edith Smith, is a competent and qualified person to prosecute this proceed-
<br />ing, th ^t said deceased left surviving him as his heirs at law, and his only heirs at law,
<br />Elizabeth Williams, his widow,
<br />Ira C.Williams, Charles I.Williams, and Lafe Williams, his sons, and
<br />Minnie W.Chapman, Kate English, Edith Smith and Hattie Byers, his daughters,
<br />that upon the death of the said James Williams the real estate hereinbefore described passed and
<br />descended by absolute title under the intestate laws of the State of Nebraska, in force at the
<br />time of the death of the said James Williams, as follows:

<br />subject, however, to the homestead rights of the said Elizabeth Williams in and to said premises;
<br />that the said! James Williams was at the time of his death a resident and inhabitant of Hall County,
<br />Nebraska.
<br />IT IS Ft11?TH>JR ORDERED, ADJUDGED AND DECREED BY THE COURT that all debts of said deceased and of
<br />his estate, if any such there were, are forever barred and precluded, and that further administra-
<br />tion of the estate of James Williams is hereby dispensed with and the said estate is finally
<br />settled and forever closed.
