<br />SEVENTH.
<br />The balance of my estate, not to exceed the sum of Fifteen Thousand ($15,000.00) Dollars, I
<br />give, devise and bequeath, in equal shares, to my children Eleanor Highland and Elton Highland,
<br />subject to the following conditions: It is my wish that my wife, Emma Highland, act as guardian
<br />for said children, and that she advise and consult with my executor, herein named, in investing
<br />the shares of said children in first real estate mortgages and government bonds, I further direct
<br />that all of the income from the shares of said children shall be paid to my wife, Emma Highland,
<br />for her own use, and that no part of the principle sum shall be paid to said children except as
<br />hereinafter provided, excepting in case of extreme necessity, then ten (10%) per cent of said
<br />shares may re used for and in behalf of said children each five years, If there be no extreme
<br />necessity, then I direct that one -third of the shares of each child shall be paid to said child
<br />on his or her twenty -first birthday, and. it there be any remainder, then an additional one -third
<br />on his or her twenty -fifth birthday and if t`.ere be any remaining, the balance on his or her thir-
<br />tieth birthday. I further direct that in the event is is necessary, after the children become of
<br />the age of eighteen years, then ten (10 %) per cent, o said. principle su.m may be used for educational
<br />purpos -s for said children, per annum.
<br />EIGHTH
<br />I give, devise and bequeath unto my wife, Emma Highland, all the rest, residue and remainder of
<br />my estate, real and personal, of every description and wherever the same may be situated, which
<br />I now have and own or may hereafter acquire.
<br />I hereby constitute and appoint William Suhr, an attorney of Grand Island, Hall County,
<br />Nebraska., executor of this my Last Will and Testament. I hereby revoke all former wills made
<br />by me.
<br />IN WITNESS WHEREOF, I have hereunto set my hand this 2nd day of June, 1923.

<br />12th day of January, 1924, the instrument purporting to be the last will and testament of Jay L.
<br />Highland, deceased, was filed for probate in this Court. That on the 7th day of February, 1924, said
<br />instrument to which this certificate is attached was duly proved., probated and allowed as the last
<br />will and testament of the Peal and personal estate of said Jay L.highland, deceased, and the same
<br />was ordered to be recorded in the records of the Court aforesaid.
