<br />BE IT REMEMBERED that on the 23rd day of June, 1942, Matilda Mattke, also kndwn as Mathilda
<br />Mattke, and being one and the same person, as Executrix of the Estate of George iludwig-- M&tt,�e,
<br />deceased, filed in this Court her final account as such Executrix and a petition praying that
<br />said account be allowed; for a decree of heirship, an order of distribution and final settlement
<br />thereon and discharge.
<br />For these purposes the 22nd day of July, 1942, at 10 o'clock A.M. at the County Court Room in
<br />said. County was assigned as the time and place for hearing said petition, examining and allowing
<br />said.account; and it was ordered that notice of the pendency of said petition and the hearing
<br />thereof be given to all persons interested in said matter by publishing a notice of said order in
<br />the Grand Island Independent, a legal newspaper printed and published in said County for three
<br />successive weeks prior to said day of hearing; and it appears by proof on file that said notice
<br />was given as ordered by this Court and that no objections to said report and petition have been
<br />filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premises, the Court finds as follows:
<br />FIRST
<br />That George Ludwig Mattke, also known as George L.Mattke, departed this life on the 9t.b day of
<br />September, 1941, in Grand Island, Hall Cpunty, Nebraska, testate, and at the time of his death he
<br />was a resident of Hall County, Nebraska.
<br />SECOND
<br />That on the 15th day of January, 1942, Matilda Mattke filed in this Court an instrument purport-
<br />ing to be the Last Will and Testament of said George Ludwig Mattke, deceased, also known as George
<br />L.Mattke, and a petition offering said Will for probate wherein she and Otto L.Mattke, a brother
<br />of said testator, were named Executors, and setting forth that said Otto L.Mattke had proceeded
<br />said testator in death and further naming the following as the heirs -at -law and only heirs -at -law
<br />of said George Ludwig kattke, deceased, to -wit: Matilda Mattke, his widow, who was designated in
<br />said Last Will and Testament as Mathilda Mattke, Helen Mattke, a daughter, Anna Mattke,Menck, a
<br />daughter and Otto L.Mattke, a son,all over the age of 21 years; that on the 15th day of January,
<br />1942, an order of this Court was made therein assigning the 13th day of February, 1942, at 10
<br />o'clock A.M. at the County Court Room in said County as the time and place for hearing said
<br />petition and ordering that notice be given to all persons interested in said matter by publishing
<br />a notice of said order in the Grand Island Independent, a legal newspaper printed in said County,
<br />for three successive weeks prior to said day of hearing, and it appears by proof on file that notice
<br />of said order was given as ordered by this Court.
<br />THIRD
<br />The Curt further finds that on the 13th day of February, 1942, at said hearing, said instrument
<br />purportjrg to be the Last Will and Testament of said George Ludwig Mattke, deceased, was duly
<br />proved, probated and allowed as the Last Will and Testament of said George Ludwig Mattke, deceased
<br />in words as follows:
<br />LAST WILL AND TESTAMENT OF GEORGE L.MATTKE
<br />I, George L.Mattke, of Grand Island,Hall County, Nebraska, do hereby declare this to be my Last
<br />Will and Testament, hereby revoking all former wills and testamentary instruments by me made.
<br />I order and direct that my Executors shall pay all of my just debts and funeral expenses as
<br />soon after my decease as conveniently may be done.
<br />After the payment of such debts and expenses, I give, devise and bequeath all of the rest,
<br />residue and remainder of my property, both teal and personal, of every kind and nature, to my
<br />beloved wife, Mathilda Mattke, to have the same absolutely.
<br />LASTLY, I hereby make, constitute and appoint my wife, Mathilda Mattke, and my brother, Otto L.
<br />Mattke, as Executors of this my Last Will and Testament.
<br />IN WITNESS WHEREOF, I have hereunto subscribed my name this 16th day of July, A.D., 1934.
