<br />The Court finds that said report is true and correct in all things and is hereby approved and
<br />allowed as and for the final report of said executor.
<br />The Court finds that Anna Schimmer died on the 1st day of.January, 1942, and at the time of
<br />her death was a resident and inhabitant of Hall County, Nebraska.
<br />That on January 8, 1942, Martin Schimmer and Walter Schimmer filed a petition herein, praying
<br />for the allowance and probate of an instrument purporting to be the last will and testament of
<br />Anna Schimmer, decea.sed,that the Court thereupon fixed the 4th day of February, 1942, as the date
<br />for making proof thereof, and due and legal notice was given of the time and place fixed for hearing
<br />thereon, as ordered by the Court, and on said date, February 4, 1942, said Instrument was duly
<br />proven, allowed and admitted to probate as and for the last will and testament of Anna Schimmer,
<br />deceased, and letters testamentary were duly issued thereon to Martin Schimmer,executor, as named
<br />in said last will and testament, and he thereupon duly qualified as sucht
<br />The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for hearing of claims against said estate, that all claims herein allowed,
<br />and costs of administration, have-been paid and settled, as shown by the receipts filed herein.
<br />The Court finds that the time for filing claims has expired, and IT IS, THEREFORE, ORDERED,
<br />ADJUDGED AND DECREED BY THE COURT that any and all claims against said estate, and not filed herein,
<br />if any such there be, are forever barred and excluded.
<br />The Court finds that Anna Schimmer died seized as the owner in fee simple of the following des-
<br />cribed real estate, and interest in real estate:
<br />The easterly one -half of the westerly one -half of the northerly one -half of Block 9 of
<br />Windolph's Addition (what would be Lot 3 of said block if same were subdivided as other
<br />lots in said addition), in Grand island,Hall County, Nebraska,
<br />The south half of the northeast quarter, the north twenty acres of the southeast quarter, of
<br />Section Eight (8), in Township Ten (10) North of Range Ten (10) West of the 6th P.M., in Hall
<br />County, Nebraska, and
<br />An undivided 2 /7ths interest in and to
<br />the north half of Section 2, Township 21, North,Range 49 west; the north half of Section 3,
<br />Township 21 North,Range 49 West the south half of Section 34, and the south half of Section
<br />35, in Township 22 North,Range 49 West, all in Morrill County, Nebraska.
<br />and that under the terms of the last will and testament of said Anna Schimmer, deceased, said
<br />real estate passed to Martin Schimmer and Walter Schimmer, sons, share and share alike.
<br />The Court finds that said estate was not subject to an inheritance tax.
<br />The Court further finds that there was not personalty sufficient to pay the claims filed
<br />against said estate, the costs of administration, etc., that an amount sufficient to pay the
<br />claims, costs, etc., has been advanced by Walter Schimmer and Martin Schimmer, sole legatees and
<br />devisees, and no claim is made against said estate for such advancement.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of the
<br />Executor be, and the same is hereby, approved and allowed as and for his final report, and said
<br />estate is hereby settled and closed, and said Executor discharged, and his bond as such is hereby
<br />released.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the real estate described as
<br />follows:

<br />and under the terms and provisions of the last will and testament of Anna Schimmer, deceased.

<br />Certificate of Probate of Will and Final Decree - IN THE MATTER OF THE ESTATE OF ANNA SCHIMMER,
<br />DECEASED, with the original record thereof, now remaining in said Court, that the same is a correct
<br />transcript thereof, and of the whole of such original record; that said Court is a Court of Record
<br />having a seal, which seal is hereto attached; that said Court has no Clerk authorized to sign
<br />certificates in his own name, and that I am the legal custodian of said Seal and of the Records of
<br />said Court, and that the foregoing attestation is in due form of law.
