<br />At a, session of the County Court held in and for said County of Hall this 1st day of July,
<br />1942, Present: Paul N.Kirk, County Judge.
<br />BE IT REMEMBERED that on the 6th day of June, 1942, Mary Rathman, as Executrix of the estate
<br />of Funs Rathman, deceased, filed in this Court her final account as such Executrix and a petition
<br />praying that said account be allowed; for decree of heirship, an order of distribution and final
<br />settlement thereon and discharge.
<br />For these purposes the lst day of July, 1942, at 10 o'clock A.M. at the County Court Room in
<br />said County was assigned as the time and place for hearing said petition, examining and allowing
<br />said account; and it was ordered that notice of the pendency of said petition and the hearing
<br />thereof be given to all persons interested in said matter by publishing a notice of said order
<br />in the Grand Island Independent, a legal newspaper printed and published in said County
<br />for three successive weeks prior to said day of hearing; and it appears by proof on
<br />file tn:_t said notice was given as ordered by this Court and that no objections to said report
<br />and petition have been filed.
<br />Upon examination of the record and the evidence in this matter and being duly advised in the
<br />premisea, the Court finds as follows:
<br />FIRST
<br />11ha.t Hans Rathman departed this 1-ife on the 1st day of January, 1942, in Grand Island, Hall
<br />County, Nebraska, testate, and at the time of his death he was a resident of Hall County, Nebraska.
<br />SECOND
<br />That on the 12th day of January, 1942, Mary Rathman filed in this Court an instrument purporting
<br />to be the Last Will and Testament of said Hans Rathman, deceased, and a petition offering said
<br />Will for probate wherein she wps named Executrix, and naming the following as the heirs -at -law
<br />and only heirs -at -law of said Hans Rathman, deceased, to -wit: Mary Rathman, his widow, Edward
<br />Rathman, a son, Fred Rathman, a son, Linda Rathman Mayer, a daughter, Evelyn Rathman Gibbs, a
<br />daughter, Margaret Rathman Wellwood, a daughter, and Glenna Rathman, a daughter, all over the
<br />age of 21 years; and on the 12th day of January, 1942, an order of this Court was made therein
<br />assigning the 2nd day of February, 1942, at 10 o'clock A.M. at the County Court Room in said
<br />County as the time and place for hearing said petition and ordering that notice be given to
<br />all persons interested in said matter by publishing a notice of said order in the Grand Island
<br />Independent, a legal newspaper printed in said County, for three successive weeks prior to said
<br />day of hearing, and it appears by proof on file th;=.t notice of said order was given as ordered
<br />by this Court.
<br />THIRD.
<br />The Court further finds that on said 2nd day of February, 1942, at said hearing, said instru-
<br />ment purporting to be the Last Will and Testament of said Hans Rathman, deceased, was duly proved,
<br />)robated and allowed as the Last Will and Testament of said Hans Rathman, deceased, in words as
<br />follows:
<br />THE LAST WILL OF' HANS RATHMAN
<br />I, Hans Rathman of Grand Island,Make this my last will, hereby revoking all former wills.
<br />I apoint my wife Mary Rathman Executrix of this will without bond.
<br />To my dearly beloved wife I give all my personal property of whatsoever kind and nature
<br />to be hers forever.
<br />All my real estate I give to my wife for and during the term of her natural life and at
<br />her death said real estate shall go to my said six children, share and share alike, and
<br />to their heirs forever, to -wit: To Edward Rathman, Fred Rathman, Linda Rathman Mayer,
<br />Evelyn Rathman, Margaret Rathman and Glenna Hathman.
