<br />The Court further finds that the said Anna Lorenzen was possessed of the following described
<br />real estate and interest therein in the state of Nebraska at the time of her death, viz:
<br />An Undivided thirteen - nineteenth (13/19) interest in Lots Three (3) and Four (4) in the North-
<br />west Quarter (NW4) of Section Two (2), Township Nine (9),North Range Eleven (11),West of the
<br />6th P.M.; and in the South Half of the Southwest Quarter (S SW ;) and the Northwest Quarter
<br />of the Southwest Quarter (NW4SW4) of Section Thirty -five (35), Township Ten (10),North,Range
<br />Eleven (11) , West of the 6th P.M., Hall County, Nebraska.
<br />The Court further finds that the said Anna Lorenzen left surviving her as her heirs -at -law and
<br />only heirs -at -law four children, being Otto E.Lorenzen, Minnie A.Burmood, Rudolph J.Loren;,�en, and
<br />Emil H.Lorenzen, sons and daughter; that under the terms and provisions of the Last Will and testa-
<br />ment and Codicil of the said Anna Lorenzen, she devised. the real estate hereinabove described,
<br />together with any personalty still on hand after the payment of all claims and debts and the ex-
<br />penses of these proceedings, to the said Otto E.Lorenzen, Minnie A.Burmood, Rudolph J.Lorenzen and
<br />Emil H.Lorenzen, to each an undivided one- fourth therein, share and share alike, to have and to
<br />hold the same to themselves and to their heirs and assigns forever, and ti'iat the aforesaid interest
<br />in said real estate passed and descended to them accordingly.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report of the said
<br />Rudolph J.Lorenzen, Executor of the estate of Anna Lorenzen, deceased, be, and the same is, in all
<br />things approved and allowed as and for the Final Report of said executor and that said estate is
<br />hereby settled and closed and said Executor discharged and that the sureties on his bond as such
<br />are released from further liability.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that all persons having claims against
<br />said estate, if any such there be, are forever barred, enjoined and excluded from setting up or
<br />asserting any such claims against said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the undivided interest in the
<br />real estate hereinabove described passed and descended to Otto E.Lorenzen, Minnie A.Burmood.,
<br />Rudolph J.Lorenzen and Emil H.Lorenzen, each an undivided one - fourth thereof, to have and to hold
<br />the same to themselves and to their heirs and assigns forever, share and share alike.

<br />HAZEL F.KIRKMAN, Deceased. )
<br />Now on this 25th day of June, 1942, this matter came on for hearing on the petition of Howard
<br />W.Kirkman for determination of heirship of the estate of Hazel F.Kirkman, deceased, and was sub-
<br />mitted to the Court, it appearing from the records and files in this matter that notice of the
<br />time and place fixed for hearing on said petition has been given by publication thereof in the
<br />manner and form provided by law as by order of said Court heretofore made and entered; whereupon
<br />Howard W. Kirkman was sworn and testified.
<br />On consideration of the evidence, the Court finds that Hazel F.Kirkman died on May 10, 1940;
<br />that she was at the date of her death a resident of the County of Hall and State of Nebraska;
<br />that she died intestate, that more than two years have elapsed since the date of her death; that
<br />no application has been made for the appointment of an administrator of her estate by any heirs or
<br />persons claiming to be her creditors; that at the time of her death, she owned the following des-
<br />cribed real estate situated within this State, to -wit:
<br />Lot One (1) in Block Eight (8) in Koehler Place, in the City of Grand Island, Hall County,
<br />Nebraska,
<br />which real estate was the home and homestead of the said Hazel F.Kirkman and Howard W.Kirkman, her
<br />husband; that the sole and only heirs of said decedent and the sole persons interested in her estate
<br />were her husband, Howard W.Kirkman, and her mother, Margaret Savage; that she left her surviving
<br />no child or children or the issue of any deceased child or children, and that her father predeceased
<br />her; that the said Margaret Savage on January 23, 1941, conveyed her interest in said premises to
<br />the said Howard W.Kirkman, and that the said Howard W.Kirkman is now the sole owner of the real
<br />estate hereinbefore described.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that Hazel F.Kirkman died intestate
<br />on May 10, 194o; that her sole and only heirs were her husband, Howard W.Kirkman, and her mother,
