WILL AND DECREE A <br />141 <br />LAST WILL AND TESTAMENT CF CATHERINE FUSS <br />I, Catherine Fuss, of Grand island, Nebrask.a, being of sound mind and. disposing memory, do <br />make, publish, and, declare this,. my last will and testament: <br />FIRST. <br />I direct that all of my just debts, including the expenses of my last sickness and burial, <br />be first paid out of my estate. <br />SECOND. <br />I give, devise, and bequeath unto my children, Conrad Fuss, Katrina Margretha Paulley, and <br />Katie Kehn, all of the rest, residue, and remainder of my property, real, personal, and mixed, <br />wherever the same may be situated, and which I now own or which I may hereafter acquire, share <br />and share alike. In the event of the death of any of the aforesaid children, then the children <br />of such deceased parent shall take equally the share of their parent. That on the 10th da _of April <br />1940, said instrument to which this certificate is attached was duly proved, i�robated. and allowed <br />as the last will and testament of the real and personal estate of said Catherine Fuss deceased, <br />and the same was ordered to be recorded in the records of the Court aforesaid. <br />The Court further finds that said Catherine Fuss departed this life on the 11th day of March, <br />1940, and at the time of her death was a resident and inhabitant of Hall County, Nebraska, that <br />on March 19, 1940 a petition was filed in the County Court of Hall County, Nebraska, praying for <br />the allowance and probate of an instrument purporting to be the last will and testament of <br />Catherine Fuss, deceased, and the Court thereupon fixed the 10th day of April, 1940, as the <br />date for making proof thereon, due and legal notice thereof was iven, and on the 10th day of <br />April, 1940, said instrument was duly proven, allowed, and admitied to probate in this Court as <br />and for the last will and testament of Catherine Fuss, deceased, and letters testamentary were <br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, this <br />10th day of April, 1940. <br />Paul N.Kirk <br />(SEAL) County Judge <br />HALL COUNTY, NEBRASKA F 1 L E D APR 10 1940 PAUL N. KIRK COUNTY JUDGE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />In the matter of the estate ) <br />of ) FINAL DECREE. <br />Catherine Fuss, Deceased. ) <br />Now, on this 24th lay of September, 1941, this cause came on for hearing upon the final report <br />of William Suhr, Executor of the last will and testament of Catherine Fuss, deceased, and upon <br />his petition for settlement of said estate, <br />The Court, having examined said report and the records and files in said. estate, and being <br />duly advised, finds that due and legal notice has been given to all persons interested in said <br />estate of the time and place fixed for hearing upon said final report, as heretofore ordered by the <br />Court, and no one appearing to object, the Court examined the same, together with the vouchers on <br />file and testimony in support thereof, and being duly advised, finds said report true and correct <br />in all things and that said report be approved and allowed as and for the final report of said <br />executor.
