THEAUGUSTINECO. 20112.2.41 <br />CERTIFICATE OF PROBATE OF WILL <br />STATE OF NEBRASKA ) <br />HALL COUNTY )ss• At a Session of the County Court held in the County Court Room in Grand <br />Island, in said County, on the 18th day of July A.D., 1941. <br />Present Paul N.Kirk, County Judge. <br />In the Matter of the Estate of <br />Alice E.Hoppel, Deceased. <br />I, Paul N.Kirk., Judge of the County Court, in and for said County, do hereby certify that on the <br />21st day of June, 1941, the instrument purporting to be the last will and testament of Alice E.Hoppel <br />deceased, was filed for probate in this Court. That on the 18th day of July 1941, B4id instrument <br />to which this certificate is attached was duly proved, probated and allowed as the last will and tes- <br />tament of the real and personal estate of said Alice E.Hoppel deceased, and the same was ordered to <br />be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, this <br />18th day of July 1941. <br />Paul N.Kirk <br />(SEAL) County Judge <br />IN ThE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />IN THE MATTER OF THE ESTATE ) <br />OF )FINAL DECREE <br />ALICE E.HOPPEL, DECEASED. ) <br />This matter coming on to be heard on the 6th day of June, 194 ?, upon the Final Report of John <br />E.hoye, Executor of the Estate of Alice E.Hoppel, deceased, and upon the petition of said Executor <br />for the allowance and approval of said report, the settlement of said estate, and his discharge here- <br />in, and the Court being fully advised in the premises finds that due and legal notice has been given <br />to all persons of the time and place fixed by the court for the hearing upon the Final Report and <br />there being no objections thereto and the Court, having examined the same together with the vouchers <br />on file, finds that said report is true and that the same ought to be approved and allowed as and <br />for the Final Report of said Executor, said estate settled and closed, and said Executor discharged. <br />The Court further finds that the said Alice E.Hoppel departed this life on June 18, 1941, and that <br />at the time of her death she was a resident and inhabitant of Hall County, Nebraska; that she died <br />testate, and that a petition was filed on the 21st day of June, 1941 asking that said Will be ad- <br />mitted to probate and that Letters Testamentary be issued to John E.Aoye, of Wood River, Nebraska, <br />upon the goods, chattels, rights and credits of the said Alice E.Hoppel, deceased, pursuant to the <br />terms and. provisions of said Will, and that upon hearing had upon said petition after notice was <br />duly given to all persons interested in said estate said Will was admitted to probate as the Last <br />Will and Testament of the said Alice E.hoppel, deceased, on the 18th day of July, 1941, and Letters <br />Testamentary were issued by this Court to the said John E.Hoye. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for filing claims against the estate of said deceased and that the time so <br />fixed has fully expired and that all persons having claims against said estate and not filed within <br />the time limited by the Court are forever barred and excluded from setting up or asserting any such <br />claim against said estate; that all claims filed against saio estate and the costs of these proceed- <br />ings are paid. <br />The Court further finds that the estate of said'deceased is not subject to an inheritance tax <br />under the laws of the State of Nebraska, nor to a Federal Estate Tax under the laws of the United <br />States. <br />The Court further finds that the said Alice E.noppel was possessed of the following described <br />real estate in the State of Nebraska, at the time of her death, viz: <br />All of Lot Thirteen (13) and all of Lot Fourteen (14) in Brett's Addition to the village of <br />Wood River, Nebraska, and all of Lot Fifteen (15) in said Brett's Addition to the Village of <br />Wood River, Nebraska, excepting the following described tracts: beginning at a point on the <br />north line of said Lot Fifteen (15) 74.6 feet west of the original east point of said lox, <br />thence running west along the north line of said lot 140.0 feet, thence running south parallel <br />to the west line of said lot 51.9 feet to the northerly line of the tract conveyed to the <br />state of Nebraska by deed recorded in Book 71, at page 685, of the deed records of Hall <br />County, Nebraska, running thence northeasterly along the northerly line of said tract 148.1 <br />feet, more or less, to the place of beginning. Also, excepting tract deeded to the State of <br />Nebraska and recorded in Book 71, page 685. <br />The Court further finds that the said Alice E.Hoppel left surviving her as her heirs at law <br />heirs law Elmer L.Hoppel Edgar B- Hoppel, Marvin Hoppel, Donald J.Hoppel <br />and only at and sons, and <br />and John Hoppel, Grandsons, they being children of Earl Hoppel, a deceased son; that under the terms <br />and provisions of the Last Will and. Testament of the said Alice E.Hoppel, she devised the real <br />estate hereinabove described, together with any personalty still on hand after the payment'of all <br />claims and debts and the expenses of these proceedings to Edgar B.80ppel, an undivided three - fourths <br />thereof and to Elmer L.Hoppel, an undivided one- fourth thereof, to have and to hold the same forever, <br />and that the aforesaid real estate passed and descended to them in those proportions. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the Final Report'of the said <br />John E.Hoye, Executor the Estate Alice E.Hoppel, deceased, be, the is, in <br />of of and same all things <br />approved and allowed as and for the Final Report of said Executor and that said estate is hereby <br />settled and closed and said Executor discharged and that the sureties on his bond as such are released <br />from further liability. <br />IT IS FURTHER ORDERED ADJUDGED AND DECREED BY THE COURT that all persons having claims against <br />said estate, if any such there be, are forever barred, enjoined and excluded from setting up or <br />asserting any such claim against said estate. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that the real estate hereinabove described <br />passed and descended to Edgar B.Hoppel an undivided three - fourths thereof and to Elmer L.Hoppel, an <br />undivided one - fourth thereof, to have and to hold the same forever. <br />Paul N.Kirk <br />COUNTY JUDGE. <br />
