135 <br />3• <br />In the Matter of the Estate <br />of <br />Christina Matthiesen, deceased. <br />I, Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on <br />the 9th day of May 1940, the instrument purporting to be the last will and testament of Christina <br />Matthiesen, deceased, was filed for probate in this Court. That on the 6th day of June 1940, said <br />instrument to which this certificate is attached was duly proved, probated and allowed as the last <br />will and testament of the real and personal estate of said Christina Matthiesen, deceased, and the <br />same was ordered to be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF I have hereunto set my hand and affixed the seal of the County Court this <br />6th day of June 1940. <br />Paul N. Kirk <br />(SEAL) County Judge <br />HALL COUNTY, NEBRASKA F I L E D JUN 6, 1940 PAUL N.KIRK COUNTY JUDGE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />IN THE MATTER OF THE ESTATE OF: D E C R E E <br />CHRISTINA MATTHIESEN, DECEASED: <br />NOW on this 27th day of May, 1942, this cause same on for hearing upon the final report filed <br />herein by Henry Matthiesen, executor of the estate of Christina Matthiesen, deceased, and upon <br />his application for t -e approval and allowance of said report, settlement of said estate and his <br />discharge as executor of said estate, and the court having examined the records and files herein, <br />including said report and vouchers thereto attached, and being fully advised in the premises finds <br />as follows: <br />That on the 9th day of May, 1940, Henry Matthiesen filed his petition in this court in which <br />he alleged, among other things, that Christina Matthiesen departed this life in Hall County, Nebraska, <br />on the 4th day of May, 1940, leaving a Last Will and Testament in which Henry Matthiesen was named <br />executor thereof, which instrument he offered for probate as the Last Will and Testament of said <br />deceased, and asking that an executor thereof be appointed; that upon reading and filing said <br />petition this court entered an.Order fixing the time and place for hearing said petition and giving <br />notice thereof, as provided by law, and that said matter coming on to be heat.d upon the date fixed <br />by the court, said instrument was duly admitted to probate in this court as the Last Will and Testa- <br />ment of said deceased and letters of administration were issued to the said Henry Matthiesen. <br />That due and legal notice has been given to all persons of the time and place fixed by the court <br />for filing claims against said estate, and all said claims not filed within the time fixed by the <br />court, if any such there be, should be forever barred, excluded and enjoined from setting up or <br />asserting any claims against said estate. <br />That said deceased departed this life leaving as her heirs at law and only heirs at law, devisees, <br />legatees and persons entitled to share in her estate the followin named persons: Wilhelm Matthiesen, <br />son, Lyman, Nebraska, Henry Matthiesen, son, Doniphan, Nebraska, ulius Matthiesen, Jr. , son, <br />Silverton, Oregon, Augusta Knuth, daughter, Grand Island,Nebraska, hosa Hann, daughter, Grand Island, <br />Nebraska, and Lillie Bennetsen Reynolds, daughter, Honolulu, Hawaii, all of which said heirs are <br />full, legal age. <br />That the deceased departed this life the owner, in fee simple title, in and to the following <br />real estate, to -wit: <br />North Half of the Northwest Quarter (NJNWJ), Section Three (3), Township Ten (10),Range <br />Nine (9),West of the 6th P.M., Hall County, Nebraska, and <br />A life estate in the <br />South Half of the Southwest Quarter (S-g'-SWJ) Section Thirty -four (34), Township Eleven (11) <br />Range Nine (9),West of the 6th P.M., Hall. County, Nebraska, and <br />A piece of ground described as follows: <br />Commencing at a point on the Southerly side of Lot No. Thirteen (13) of the County Sub- Division <br />of the South Half (SJ) of the Southeast Quarter (SEJ) of Section No. Sixteen (16), Township <br />Eleven (11) North of Range Nine (9) W., 171 feet Easterly of the Southwest (SW) Corner of said <br />Lot, running thence Easterly along spid Southerly side 66 ft., thence running at right angles <br />in a Northerly direction 180 feet, running thence at right angles in a Westerly direction 66 feet <br />I hereby nominate my beloved son, Henry Matthiesen, executor of this my Last.Will and Testament <br />and request that he be <br />allowed to serve without giving bond. <br />In witness whereof I <br />have hereunto set my hand this 4th day of Oct., 1939. <br />Evelyn J.Hayes <br />Christina Matthiesen <br />Witness <br />Testatrix <br />Lloyd W.
