<br />William Guenther,Deceased. )
<br />Now on this 17th day of April,1942,this cause came on for hearing upon the Petition for Determin-
<br />ation of Heirship,of William Guenther filed herein on March 27,1942,and the same having been
<br />submitted to the Court,the Court finds that on the 27th day of March,1942,an Order for Hearing
<br />on the Petition for Determination of "eirship was made and entered herein assigning the 17th day
<br />of April,1942,at the hour of nine o'clock a.m.,as the day and time for the hearing of said Peti-
<br />tion;that due Notice of the hearing on said Petition has been given as required by law and the
<br />order of the Court heretofore entered herein,and that proper Proof of Publication of said Notice
<br />has been filed herein.
<br />The Court further finds that the allegations as set out in the Petition filed herein are true and
<br />correct,and that the said William Guenther departed this life intestate while a resident of
<br />Seward County,Nebraska, n 8th day of August 1924,and that at the time of his death he was the
<br />owner of the following,,rea estate towit:
<br />The East Half of the Southwest Quarter (EJ SWJ) of Section Thirty -one (31),Township Ten (10),
<br />North,Range Eleven (11),West of the 6th P.M.,Hall County,Nebraska.
<br />The Court further finds:
<br />That the said William Guenther left surviving him,as his only heirs at law,and as the only persons
<br />interested in his estate,John Guenther,a son;George W.Guenther,a son;Sophie Rumler,a daughter;
<br />Anne E.Flatemersch,a daughter ;Amelia Yordy,a daughter;Marie Rogers,a daughter ;Anna K.Blain,a
<br />daughter ;Katie Parker,a daughter ;Dora Schultz,a daughter:
<br />That his estate descended in equal shares to his children above named.
<br />That more than two years have elapsed since the date of the death of said decedent,and that no
<br />administrator has been appointed in Nebraska; that all his debte,and the claims against his
<br />estate,of whatsoever kind,have been fully paid;and that the interest of the petitioner in said
<br />realty,is that of owner in fee simple,of all of it.
<br />It is,THEREFORE,adjudged and decreed by the COURT,that the said William Guenther died intestate,
<br />as hereinbefore found;that he died seised and possessed of the realty described above;that he 1 df t
<br />surviving him,as his only heirs,and as the only persons interested in his estate, his children
<br />herein above named ;that said realty,of which said decedent died seised and possessed,descended
<br />at the time of his death,by operation of law in equal shares to his children above named ;that
<br />more than two years have elapsed since the date of the death of said decedent ;that no administrator
<br />has been appointed in Nebraska;that all claims,debts,or demands,against the estate of said
<br />decedent,of whatever kind, }lave been fully paid;that all claims,debts,or demands against said
<br />estate,whether due or to become due,whether absolute or contingent,should be,and they are forever
<br />barred from becoming charges against said estate; that the interest of said petitioner in and to
<br />said realty is that of owner in fee simple,of all of it.
<br />It is further ORDERED,ADJUDGED AND DECREED by the Court,that each of the findings hereinabove
<br />made,should be,and it is hereby made a part of the DECREE of this COURT,as fully as if set out at
