<br />the said Sarah Elizabeth Johnson, and distribution thereof is hereby accordingly made.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that in the proceedings of thi -s estate
<br />the name of John L.Johnson appears as John L.Johnson and also as J.L.Johnson, and whenever it
<br />appears that way it refers to one and the same person; and that in the proceedings of this estate
<br />the name of Sarah Elizabeth Johnson aiyoears as Sarah Elizabeth Johnson, and also as Sarah E.Johnson,
<br />and also as Mrs.John L.Johnson, and also as Mrs. J.L.Johnson, and whenever it apoears that way it
<br />refers to one and the same person.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that this estate is not subject to
<br />either federal or state inheritance taxes.

<br />In the Matter of the Estate of ) Decree Determining Heirship
<br />Elizabeth Guenther Deceased. )
<br />Now on this 17th day of April,1942,this cause came on for hearing upon the Petition for Determin
<br />ation of heirship, of Elizabeth Guenther filed herein on March 27,1942,and the same having been
<br />submitted to the Court,the Court finds that on the 27th day of March,1942,an Order for Hearing on
<br />the Petition for D..etermination of Heirship eras made and entered herein assigning the 17th day of
<br />Apri1,1942,a.t the hour of nine o'clock a.m.,as the day and time for the hearing of said Petition;
<br />that due Notice of the hearing on sated Petition has been given as required by law and the order
<br />of the Court heretofore entered herein,and that proper Proof of Publication of said Notice has
<br />been filed herein.
<br />The Court further finds that the allegations as set out in the Petition filed herein are true and
<br />correct,and that the said Elizabeth Guenther departed this life intestate while a resident of
<br />SewardCounty,Nebraska,on the 9th day of February 1922,and that-at the time of her death she was
<br />the owner of the following described real estate towit:
<br />The East half of the Southwest Quarter (EJ SWJ) of Section Thirty -one (31),Township Ten (10),
<br />North,Range Eleven (11),Weat of the 6th P.M.,in Hall County,Nebraska.
<br />The Court further finds:
<br />That the said Elizabeth Guenther left surviving her,as her only heirs at
<br />law,and as the only persons interested in her estate,John Guenther,a son;George W.Guenther,a son,
<br />Sophie Rumler,a daughter ;Anne E.Flatemerach,A daughter;Amelia Yordy,a daughter ;Marie Rogers, a
<br />daughter ;Anna K.Blain,a daughter;Katie Parker,a daughter ;Dora Schultz,a daughter;and William
<br />Guenther,her husband:
<br />That the real estate described above,descended by operation of lavi,one third (113) to her husband
<br />and 213 to her children.
<br />That more than two years have elapsed s_nce the date of the death of said decedent,and that no
<br />administrator has been appointed in Nebraska; that all her debts,and the claims against her estate,
<br />of whatsoever kind,have been fully paid;and that the interest of the petitioner in said realty,is tn,
<br />that of owner in fee simple,of all of it.
<br />It is,THEREFORE,adjudged and decreed by the Court,that the said Elizabeth Guenther,died intestate,
<br />as hereinbefore found;that she died seised and possessed of the realty described above;that she left
<br />surviving her,as her only heirs,and the only persons interested in her estate,her children here -
<br />inhbove named;that said realty,of which said decedent died seised and posseseed,descended at the
<br />time of her death,by operation of law in the shares set forth above;that more than two years have
<br />elapsed since the date of the death of said decedent ;that no administrator--has been appointed in
<br />Nebraska;that all claims,debts,or demands,against the estate of said decedent,of whatever kind,
<br />have been fully paid;that all claims,debts,or demands against said estate,whether due or to become
