130 <br />THEAUGUSTINECO. 20112.2.41 <br />FINAL DECREE <br />IN THE COUN'T'Y COURT OF HALL COUN`1'Y, NEBRASKA <br />In the Matter of: j <br />THE ESTATE OF ) FINAL DECREE <br />JOHN L.JOHNSON, ) <br />Deceased. ) <br />NOW, on this 28th day of March, A.D., 1942, this cause came on for hearing upon the final report <br />filed herein by Sarah Elizabeth Johnson, the duly ap °-)ointed, qualified and acting administratrix of <br />the estate of John L.Johnson, deceased, together with the petition for the approval and allowance of <br />said report, settlemerit of said estate and her discharge herein; and the Court having examined the <br />records and files herein, including said final report, .heard the evidence in support thereof, and <br />being fully advised in the premises and from proof on file, finds that: <br />1. Notice of said hearing has been duly given <br />to all persons interested in said <br />estate by <br />publication in the Grand Island Daily Independent <br />three successive weeks, as required by law: <br />2. The final report is true and correct in all <br />the <br />respects, and is hereby approved <br />is hereby settled and closed, and <br />and allowed <br />said adminis- <br />as the final report of administration, estate <br />tratrix is discharged, and surety on her official <br />bond is released from any further <br />liability in <br />said. matter; <br />3.�e notice has been given to all persons having claims against said estate of the time and <br />place, or a hearing thereon by publication in the Grand Island Daily Independent three successive <br />weeks, as provided by law, and all persons having claims against said estate, not filed within the <br />time fixed by the Court, if any such there be, should be forever barred and excluded from setting <br />up or asserting any such claims against said estate; <br />4. No claims have been filed against said estate; all expenses connected with the funeral and <br />last illness of the said John L.Johnson, deceased, have been paid in full; and all other expenses <br />of said estate have been paid in full, including Court costs, publication fees and attorney fees,, <br />and the receipts are in proper order; <br />5. All personal property in said estate should be assigned to Sarah Elizabeth Johnson, widow <br />of John L.Johnson, deceased, and administratrix herein, in lieu of and as payment in full of any <br />and all sums advanced by her personally in the management of said estate and for other costs and <br />expenditures advanced by her and for a widow's allowance as allowed by the Court; further, the <br />heirs of the estate of John L.Johnson, deceased, have all agreed to said set -off and assignment <br />of all of the personal property in said estate to the said Sarah Elizabeth Johnson, and that among <br />the heirs present in Court this date while said assignment was carefully explained, entered into <br />and decreed by the Court were the three minor heirs herein, Mary Ellen Johnson, Dolores Berlin and <br />Barbara Ann Berlin, as well as their duly appointed., qualified and acting guardian, Sarah Elizabeth <br />Johnson. <br />6. John L.Johnson passed away intestate on the 25th day of September, A.D., 1940, being at that <br />time a resident of Hall County, Nebraslr.a., and possessiong property in said County, and leaving sur- <br />viving him as his heirs -at -law and sole and only heirs -at -law, the following: <br />Mrs. Sarah Elizabeth Johnson, a widow, Hall County, Nebraska, over twenty -one years of age, who <br />is the sole and. only wife of John L.Johnson, deceased, and is the mother of all of the children <br />herein set out as sons and. daughters of John L.Johnson, deceased; <br />Ralph A.Johnson, a. son, Boelus, Nebraska, over twenty -one years of age; <br />John L.Johnson,Jr., a son, St.Michael, Nebraska, over twenty -one years of age; <br />Miss Dorothy E.Johnson, a daughter, Grand Island,Nebraska, over twenty -one years of age; <br />Miss Lucille J.Johnson, a. daughter, Sacramento, California, over twenty one years of age; <br />Miss Edna. L.Johnson, a daughter, Denver, Colorado, over twenty -one years of age; <br />Raymond E.Johnson, a son, St. Michael, Nebraska, over twenty -one years of age; <br />Miss Mary Ellen Johnson, a daughter, St.Michael, Nebraska., wno is a minor of eighteen years of <br />age, having been born on the 21st day of March, 1924 ;, <br />Miss Dolores Berlin, a granddaughter, Grand Island, Nebraska, who is a minor of nineteen years of <br />age, having been born on the 28th day of December, 1922, she being a daughter of Mrs. Esther <br />CD <br />Johnson Berlin Hueneke, deceased, daughter of John L.Johnson and who predeceased him in death; <br />Miss Barbara Ann Berlin, a granddaughter, St.Michael, Nebraska, who is a minor of thirteen years <br />of age, having been born on the 15th day of November, 1928, she being a daughter of Mrs.Esther <br />Johnson Berlin Hueneke, deceased daughter of John L.Johnson and who predeceased him in death; <br />7. At the time of his death, John L.Johnsor: was the fee owner of the following described real <br />estate; <br />(1) The South Half of the Northeast Quarter (S2NE4) of Section One (1), Township Eleven <br />(11) , North, R: nge Eleven (11) , West of the 6th P.M., in Hall County, Nebraska, con- <br />taining approximately 90 acres, more or less, according to government survey; and, <br />(2) The South Half of the West Half of the Northeast Quarter (S;46NE4); the South Half <br />of the East Half of the Northwest Quarter (S�V NWT); the East half of the Southwest <br />Quarter (E'Sld4); the West Half of the Southwest Quarter (W2SWj); and the Southeast <br />Quarter (SE$); all in Section Six S6), Township Twelve (12), North,Range Twelve (12), <br />West of the 6th P.M., in Hall County, Nebraska, containing approximately 388 acres, <br />more or less, according to government survey, subject to a mortgage of record to <br />The Travelers Insurance Company, of Hartford, Connecticut; <br />8. By virtue of the Statutes of Descent in the Compiled Statutes of the State of Nebraska, <br />in full force and effect at the date of the death of John L.Johnson, deceased, the said ab ve <br />described real estate herein set out descended, at the time of the death of John L.Johnson <br />his sole and. only heirs -at -law as herein set out in the following shares: <br />Sarah Eliz Beth Johnson; an undivided one -third (1/3) interest, or an undivided eight twenty - <br />fourths (M4) interest, she being the sole and only surviving wife and widow of John L. <br />Johnson, deceased, and she being the mother of all of the children of John L.Johnson,deceased; <br />Ralph A.Johnson, John L.Johnson,Jr., Dorothy E.Johnson, Lucille J.Jornnson, Edna L.Johnson, <br />Raymond E.Johnson, and Mary Ellen Johnson; each one of them an undivided one - eighth (1 /8) <br />of a. two - thirds (2/3) interest, or an undivided two twenty- fourths (2/24) interest; <br />
