<br />Marion Mahlin, share and share alike after satisfaction of the foregoing provisions, all of which
<br />property of decedent passing under such residuary clause is hereinafter specifically setout.
<br />15. That said executrix has herein accounted for all of the estate of said deceased which has
<br />come into her hands or into the hands of any person for her and as shown by her final report now
<br />on file herein, which report should be in all things confirmed and approved b this court said
<br />executrix now has in her hands for distribution and assignment the sum of $5249.54 and the following
<br />real and personal, to -wit:
<br />The following mortgages and debts secured thereby: Promissory note executed by Chas. Weaver
<br />as Trustee in the principal sum of $2000.00 dated July 8, 1939 and secured by first real estate
<br />mortgage on the Southwest Quarter of Section 27, Township 13 north,Range 1 East of the 6th P.M.
<br />in Butler County, ' debraska, which mortgage is recorded in Book 80 on page 718 of the mortgage
<br />records of said county, also the promissory note executed by John P.Lettellier and Elizabeth P.
<br />Rutten as executor and executrix of the estate of Frank Lettellier, deceased in the principal
<br />sum of $4510.00 dated March 31, 1939 and secured by first real estate mortgage on the Northeast
<br />Quarter and the North -half of the Southeast Quarter of Section 8, Township Fourteen (14) north,
<br />Range 3 East of the 6th P.M. in Butler County, Nebraska and recorded in Book 80 on page 130 of
<br />the records of Butler County, Nebraska.
<br />The following described real estate: The undivided one -half interest in and to Block Five O
<br />David City Land and Lot Co. Addition to the City of David City, Butler County, Nebraska, also
<br />The South -half of the Southeast Quarter of Section 29, Township 13 north,Range 1 West of the 6th
<br />P.M. in Polk County, Nebraska., which the court specifically finds was taken by warranty deed by
<br />said Mabel C.Mahlin as executrix of the last will and testament and estate of Martha E.Allen,de-
<br />ceased., pursuant to order of this court dated May 16, 1941 in compromise settlement of the debt
<br />of Chris J.Plith and wife in the principal sum of $5500.00 secured by first-mortgage on said
<br />South -half of the South -east Quarter aforesaid.
<br />Also the following described personal property:
<br />The undivided one -half interest in 50 share of stock in Nebraska -Iowa Packing Co. represented
<br />in Certificate #300 of said Company; also Participation Certificate #227 in trusteed assets of
<br />Central Nebr. Nat'l Bank of David City, Nebraska for $243.35 endorsed 1/23/35 $81.11 and balance
<br />$97.72; also Certificate #2597 in the principal sum of $200.00 dated 2/6/31 in David City Build-
<br />ing & Loan Association, David City, Nebraska, endorsed ;. Liquidation Div. #1 amount $40.00 1/30/39,
<br />Linquidation Div. #2 amount $20.00 1/20/40, Liquidation Div.#3 amount $10.00 2/15/41 and Liquidation
<br />Div. #4 amount $15.00 2/3/42,
<br />that all of the above itmfs of real estate also the personal property listed above as in the hands
<br />of said. executriX pass under the residuary clause of said will and the same should be ordered
<br />assigned and paid out to said Mabel C.Mahlin, Lucile Price, Mildred Lnenicka and Marion Mahlin
<br />share and share alike absolutely forever and upon said executrix filing herein receipts from each
<br />of said beneficiary showing payment of cash in the sum of $1312.35 and assignment of said personal
<br />property to each in undivided one - fourth interest in the interest as above set out of said
<br />decedent the same shall be in full of the distributive share of each of said beneficiary in the
<br />personal estate passing under said residuary clause of said last will and testament.
<br />That all inheritance taxes have been duly determined and paid and there is no estate tax or
<br />excise tax due owing or charEable herein.
<br />Wherefore-,it is considered, adjudged and decreed that each and all of the finding hereinbefore
<br />made be and same are by this reference incorporated herein as fully as if repeated at length and
<br />specifically ordered, adjudged and decreed; that said executrix has fully accounted herein for
<br />all of the real and personal property of said estate in her final report filed herein and same
<br />is hereby approved and confirmed in all things; that said executrix has fully satisfied each and
<br />all of provisions "First" to "Eighth" inclusive save and except provision "Seventh" and said
<br />executrix is ordered. pursuant to said provision 7th of said will and in satisfaction thereof to
<br />assign in undivided one - fourth interest the 40 share of The Lincoln Telephone & Telegraph Company
<br />stock represented by said Certificate #1516 unto said Mabel C.Mahlin, Lucile Price, Mildred Lnenicka
<br />and Marion Mahlin absolutely forever and that said executrix make due assignment to each of said
<br />beneficiary under the residuary clause of said last will and testament of said deceased of the
<br />mortgages and debts secured thereby and the stocks, bonds and personal property as herein before
<br />found and specifically described and. pay over to each the sum of $1312.35 in cash all as herein-
<br />before found and by reference decreed as passing under the residuary clause of said will and in
<br />full satisfaction thereof and upon said executrix filing herein receipts evidence such assignments
<br />and payment that said executrix be discharged as such and she and her bondsman released from all
<br />further liability.
<br />It is further Ordered, Considered, Adjudged and Decreed that:
<br />Said East 70 feet of Lots Six and the East 70 feet of the South -half of Lot Three, all in Block
<br />Four Miles First Addition to the city of David City, Nebraska, and the undivided one -half interest
<br />in and to the Northwest Quarter of Section 33, Township 9 Range 17 West of the 6th P.M. in Buffalo
<br />County, Nebraska be and same is hereby assigned and setover unto Mabel C.Mahlin pursuant to the
<br />terms and provision,-of said last will and testament of said deceased; that the Northwest Twenty
<br />acres of the West -half of the Southeast Quarter of section 17, Township 15 north,Range 1 East of
<br />the 6th P.M. Butler County, Nebraska., and the Southwest Qu -?rter of the Northwest Quarter of Section
<br />23, Township 15, north,Range 1 East of the 6th P.M. in Butler County, Nebraska, also Lot 6 in Block
<br />11 in Clark's Addition to the city of Grand Island, Nebraska, be and same is hereby assigned and
<br />setover unto Lucile Price pursuant to the terms and provisions of said last will and testament of
<br />said deceased; that the Northeast Quarter of Section 23, Township 16 north Range 1 East of the 6th
<br />P.M. in 3utler County, Nebraska., be and same is hereby assigned and setover unto Mildred Lnenicka
<br />and Marion Mahlin share and share alike pursuant to the terms and provisions of said last will and
<br />testament of said deceased; that said. undivided one -half interest of Block 5 in David City Land
<br />and Lot Co's Addition to the city of David City, Nebraska. and aslo the South -half of the Southeast
<br />Quarter of Section 25, Township 13 north,Range 1 West of the 6th P.M. Polk County, Nebraska, be
<br />and same is hereby assigned and setover share and share alike unto Mabel C.Mahlin, Lucile Price,
<br />Mildred Lnenicka and Marion Mahlin pursuant to the residuary clause of said last will and testa-
<br />ment of said Martha E.Allen, deceased.
